A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, REQUESTING BOARD OF COUNTY COM-
MISSIONERS OF PALM BEACH COUNTY TO DISTRIBUTE
BALANCE OF GENERAL ROAD AND BRIDGE TAX COL-
LECTIONS ALLOCABLE TO MUNICIPALITIES WITHIN
SAID COUNTY U'I~DER FLORIDA STATUTE SECTION
336.59 PRIOR TO END OF FISCAL YEAR ON SEPTEMBER
30, 1976.
WHEREAS, Florida Statutes Section 336. 59 requires the Palm Beach
County Commissioners to levy and collect a special tax for road and bridge
purposes and turn over to the cities within the County one half (1/2) the
amount realized from said tax on property in such incorporated cities; and
WHEREAS, the City of Boynion Beach has heretofore received the
sum of $63,607.04 representing its allocable share of the aforesaid tax funds
collected by Palm Beach County for the period from October 1, 1975, through
June 30, 1976; and
WHEREAS, since June 30, 1976, additional special tax revenues
totaling $296, 000.00 have been collected but not yet distributed to the munici-
palities within Palm Beach County; and
WHEREAS, the proportionate share due the City of Boynton Beach of
the aforesaid collected but undistributed tax revenues is believed to be approx
imate[y $5, 500.00; and
WHEREAS, the Florida Supreme Court has ruled that county com-
missioners are required to pay over to the municipalities the [afters' pro-
portionate share of said special tax revenues within a reasonable time after
the tax has been collected; and
WHEREAS, the City of Boynton Beach is entitled to receive from
Palm Beach County, prior to the end of its fiscal year on September 30, 1976,
its allocable share of the aforesaid special tax fundsi:~.previous[y collected but
as yet undistributed, in order that the City might put these proceeds to imme-
diate use in the repair and maintenance of its roads and streets, obtain the
accrual of interest on these monies and show its portion of such funds as part
of the City's 1975-76 fiScal year tax base for purposes of receiving future dis-
tributions of state and federal revenue sharing funds.
NOVF, TI~IEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA.'
Section 1: Thai the members of the Board of County Commissioners
of Palm Beach County, be and they are hereby requested to direct distribution
of the proportionate share of those funds previously collected and remaining
on hanoi in the County Commissioners General Road aad ]Bridge Tax Fund to
the City of Boynton Beach and those municipalities similarly situate a reason-
able time prior to September 30, 1976.
Section 2: Thai the City Clerk is hereby authorized and directed to
forward a certified copy of this Resolution to each member of the Board of
County Commissioners of Palm Beach County a~t~ their offices in ~Vest Palm
Beach, Florida.
