76-KK RESOLUTION NO. 76- I<K A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, ESTABLISHING DEPOSITORY AND PROCEDURE FOR RECEIPT AND DISBURSEMENT OF FUNDS IN CONNECTION WITH CON- STRUCTION OF SOUTH CENTRAL REGIONAL WASTEWATER TREATMENT AND DISPOSAL FACILITY. WHEREAS, on December 26, 1974, the City of Boynton Beach, Florida, and ~he City of Delray Beach, Florida~ entered into an Interlocal Agreement for the purpose of creating the South Central Regional Wastewater Treatment and Disposal Board (hereinafter referred to as "Board"). which Board would be vested with the responsibility of making all policies for the administration, operation, main- tenance, enlargement, development, replacement and repair of a regional waste- water treatment and disposal facility to be constructed under the terms of the EPA application ~ 75 No. C-12-0406010 (hereinafter referred to as the "project"); and WHEREAS, pursuant to its authority under the aforesaid Interlocal Agree- ment. the Board has received bids for the construction of the regional facility, an effluent force main, and the disposal of residue sludge from the facility, and is scheduled to be awarded within 120 days from June 15, 1976; and WHEREAS, it is anticipated that in the near future the United States Envi- ronmental Protection Agency will remit the sum of $352,203.00, representing the initial reimbursable payment due in connection with the project; and WHEREAS, pursuant to the terms of Section 8 of the Interlocal Agreement, the capital costs of the project are to be allocated equally between the Cities of Delray Beach and Boynton Beach; and WHEREAS, it is necessary to provide for an appropriate depository for funds received by the City of Boynton Beach as its pro rata share of the aforesaid En- Agency reimbursable payment, as well as any and all such payments to be received in the future; and WHEREAS, it is imperative that a procedure be established whereby the City of Boynton Beach will periodically contribute to the Board funds in an amount equal to the City's allocated share of those disbursements made or to be made by the Board in payment of eligible project costs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE BOYNTON BEACH, FLORIDA: Section 1: That any and all reimbursable payments received from the States Environmental Protection Agency in connection with the aforesaid shall, upon receipt thereof, be deposited in the U. S. Government Water and Sewer Grants Account $030-550-01. Section 2: That upon submission to the City by the Chief Executive Officer the Board of invoices indicating the necessity of payment for designated eligi- project costs, the City Manager, or in his absence the Mayor, or in his absence Vice Mayor, shall be authorized to approve and execute any and all checks, , drafts and withdrawal slips necessary to discharge the obligation of City of Boynton Beach under the terms of the aforesaid Interlocal Agreement share in the actual capital costs of the project.
