76-MRESOLUTION NO. 76 - M
A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA.
URGING THE BOARD OF COUNTY COMMISSIONERS OF PALM
BEACH COUNTY TO REJECT THOSE CERTAIN PROPOSED
AMENDMENTS TO PALM BEACH COUNTY ENVIRONMENTAL
CONTROL RULE ONE.
WHEREAS, for several years the Palm Beach County Health Department has
administered the "Palm Beach County Environmental Control Rule One - Individual
Sewage Disposal Systems" regulating the installation and use of septic tanks in Palm
Beach County, Florida; and
WHEREAS, the Florida Legislature has passed general rule, Chapter 75-145,
designed to stimulate the homebuilding industry by releasing certain pre-existing
statewide controls over septic tanks by allowing owners of small subdivisions of up
100 lots to build single family homes with septic tanks on lots as small as one third
acre; and
WHEREAS, the Palm Beach County CommiSsion will soon be considering the
adoption of certain amendments to Environmental Control Rule One which would in-
corporate the aforementioned provisions of Chapter 75-145 without restriction; and
WHEREAS. rejection of these amendments ~o Environmental Control Rule One
by the Palm Beach County Commission would not adversely affect the building indus-
try in the City of Boynton Beach since there exists no moratorium preventing the
Connection of individual sewer lines from single family homes to the City's utility
system; and
WHEREAS, any short-term economic benefit which may result from increased
single family residential construction made possible by adoption of the aforesaid
amendments to Environmental Control Rule One is far outweighed by their long,ran
impact as a potential public health hazard, as well as the cumulative costs of ade-
quately protecting the public water supply from contamination and attempts to pre-
serve the orderly development of residential subdivisions in Palm Beach County,
Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
DF BOYNTON BEACH, FLORIDA:
Section 1: That the Board of County Commissioners of Palm Beach County be
and is hereby urged to reject the aforesaid proposed amendments to Palm Beach
County Environmental Control Rule One permitting installation and use of septic
tanks in small urban subdivisions on tots as small as one third acre in size.
Section 2: That the City Clerk is hereby authorized and directed to forward a
certified copy of this Resolution to the Board of County Commissioners of Palm Beach
County, Florida, William Medlen, Chairman.
Section S: That this Resolution shall take effect immediately upon its passage.
