76-G RESOLUTION NO. 76-~ A RESOLUTION AUTHORIZING EXECUTION OF CONTRACT AND AGREEMENT ACCEPTING DEPARTMENT OF NATURAL RESOURCES GRANT UNDER FLORIDA RECREATION DEVELOPMENT PROGRAM WHEREAS, the City of Boynton Beach, Florida, being desirous of correcting an over all deficiency in its park and recreational areas, has proposed to develop certain recreational facilities at the Boynton Beach Canal Ramp Park located at Northwest 13th Avenue and Northwest 8th Street in the said City; and WHEREAS, the City of Boynton Beach, Florida, has filed an application with the Florida Department of Natural Resources, Division of Recreation and Parks, requesting financial assistance in the development of the aforesaid project; and WHEREAS, the Executive Board of the Department of Natural Resources, at its meeting of February 2, 1976, approved the request of the City of Boynton Beach, Florida, for such financial assistance and has awarded a grant in the amount of $34,500.00 to the City under the Florida Recreation Development Assistance Pro- gram; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the City Manager of the City of Boynton Beach, Florida, is hereby authorized to enter into the Contract and Agreement with the Executive Board of the Department of Natural Resources whereby the City agrees to construct recreational facilities at the Boynton Beach Canal Ramp Park in accordance with the project plans attached thereto in consideration of the grant of the said Depart- ment in the amount of $34,500.00 to assist in such construction, a copy of said Contract and Agreement being attached hereto and hereby made a part hereof by reference. Section 2_ :_ That the City Manager of the City of Boynton Beach, Florida, is hereby designated to act as liaison agent in behalf of the City under the terms of the aforesaid Contract and Agreement. Section- S: That the City Council of the City of Boynton Beach, Florida, hereby dedicates the property to be known as Boynton Beach Canal Ramp Park as a recreation area in perpetuity to be offered to the general public for recreational purposes only. The Department has found recreation to be the prime the Bovnton Beach Canal purpose of the project known as RamD Park ~ ~Citv and has agreed to ente~ into this contract with the for construction of recreational facilities on real property, the title o~ which is held by the City such real property more.specifically described in Exhib~"A" attached. 2. The City agrees to cause the construction of certain recreational development at the above mentioned project, such development being in accordance with the project plans attached hereto and made a part of this Agreement as Exh~it"B" 3. The City agrees to operate and maintain said recreational facilities at its own expense and covenants that it has the full legal authority and financial~.ability to so operate and maintain said fac'ilities. 4. ]?he ___qCitv agrees [o appoint a liaison officer ix) be responsible for the successful completion of the project, the prompt implementation of the articles of this Agreement, and the submission of progress ~.~eports at least every thirty (30) days from the date of the execution of this Agreement until the Project construction is certified complete. Any portion bf said funds may be released at the discretion of the Department upon official billing by the .
