A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA,
VACATING AND ABANDONING EASEMENT AND RIGHT OF WAY
IN SECTION 5, TO~qSHIP 46 SOUTH, RANGE 43 EAST,
PALM BEACH COUNTY, FLORIDA.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has initiated proceedings for ~aca%ing:&nd abanm[
doning the right of way and easement located in Section 5,
Township 46 South, Range 43 East, Palm Beach County, Florida,
as is more fully described hereinafter; and
WHEREAS, said abandonment has heretofore been considered
by the Planning and Zoning Board of the City of Boynton Beach,
Florida, and a favorable recommendation has been rendered in
connection therewith; and
WHEREAS, all affected public utilities have been con-
tacted for their recommendations in connection with said
proposed abandonment, and their recommendations have been
received; and
WHEREAS, said proposed abandonment is deemed to be
reasonable and in the best interes~ of the inhabitants of the
City of Boynton Beach, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: That the right of Way and easement lying
in and upon the following described land in Palm Beach County,
Florida, to-wit:
The North 90 feet of the West one-half (1/2)
of the Northwest one-quarter (1/4) of Section
5, Township 46 South, Range 43 East, Palm
Beach County, Florida, less the West 53 feet
thereof, subject to existing right of way of
Lake Worth Drainage District lateral canal

be and is hereby vacated and abandoned and subject area is
hereby returned to acreage for purposes of taxation.
