BE IT ORDAINED BY TH'E TOV~N C0~ISSION OF THE TOWT~ OF BOYNTON PALM BEACH COUN~, FLORiDA: 1. That there be and there hereby is levied upon all of the ~taxable property~ both real and personal, within the Town of Boynton, Palm Beach County, Florida a C~n~ral ~ax to provide for the C-E~RAL EXPE~SE of said Town as provided in the BUDGET items set forth in ORDINANCE NO. 142, to-wit; a tax sufficient to produce the sum of ELEVEN ~q0USAND TWO HUNDRED SIXTY SEVEN DOLLARS AND FORTY FIVE C~o ($11,26~.4~) 2. That ther'e b~ and there hereby is levied upon all of the taxable propertY, both real and ps~rsonal, ~ - within the Town of Boynton, Palm Beach County~ _lormda~ a Special Tax for the purpose of providing INTEREST AND SI~KING ~D 'monies to be used in the payment of the interest upon the indebtedness of the Town of Boynton~ Palm Beach County, Florida~ the sum of SIXTEEN 'THOUSAND NII~E HOUNDRED ONE DOLL~RS AND FORTY FIVE CENTS, ($18,901.~8) S. That there be and there hereby is~ levied upon real property benefited by either, or both, sewer and street improvements, Within the Town of BoYnton, Palm Beach County, Florida, a Special Tax for the purpose of pr. oviding SINKING FUND monies to be used in the payment of the redemption and retirement of the outstanding indebtedness of the Town of Boynton, Palm Beach County, Florida, the sum of FOUR THOUSAND~SIX ~JNDRED EIGHTY SEVEN DOLLARS AND TV~0 CENTS. ($4,687, ~0~): provided, however, that should the owner of any~ Property beme- fitted by any such improvement have'heretofore paid in full the cost of said improvements assessed against said property, then, in that event, the Special Tax as provided in this paragraph s_hall not be levi~ against such property. 4. Tha~t said taxes here'inbefors referred to, 'in paragraph I and paragraph B, hereOf, be and the same hereby are apportioned to and levied against all the tamable property, both real and personal, within the' CorPorate limits of the Town of BoyntOn, palm Beach County, Florida in proportion to the assessed valuation of SUch property. The valuation of all of the taxable property, both real and personal, situated within the Corporate Limits of the said Town o£ Boynton, Palm Beach County, Florida, for the taxable year 1934, which is the fiscal year ending October 31st, 1935, as shown by the Tax Assessment Roll prepared by the Tax Assessor of the said Town of Boynton, being hereby fixed at ONE MILLION ONE HUNDRED T_WENTY SIX THOUSAND SEVEN HUNDRED FORTY FiVE DOLLARS ($1,126,745.00.) 5. That the taxes hereinbefore referred to~ in paragraph 3 hereof, to create a fund to raise the sum of $3,861o90, out of the sum of set forth in said paragraph, for the purpose of providing monies necessary to retire Bonds issued by~ the To~ of Boynton, Florida~ under date of April lsb~ described as Town of Boynton, Refunding Bonds, Issue of April 1st, 195~, Series B,C and D, be extended upon the Tax Books of the Town of Boynton, Palm Beach County~ Florida, in the proper millage proportionate to the valuation thereof as returned by the Tax Assessor, that is, the millage thereof shall be as follows, to-wit, l0 ~ILLS~ which millage shall be levied against each and every lot~ tract or parcel of land against which there has heretofore been levied a special assessment for the cost of the construction of street improvements~ provided, however, that should the owner or owners of any property against which there has heretofore been levied a special assessment for the cost of the construction of street improvements have heretofore paid in full sa'id special assessments assessed against such property~ then, in that event, the Special Tax as provided in this paragraph shall not be levied against such property~ and provided~ further, that the levy of the tax as herein provided shall not deprive the Town of Boynton from the lien for said special assessments. ~¥hen such special taxes~ as provided in this paragraph, are collected, the Town Tax' Collector is hereby ordered and directed to enter the payr.~ent thereof, properly crediting the special assessment account on the properties on which the special tax has been paid. 8. That the Treasurer of the Town of Boynton~ Palm Beach County, Florida~ be and he hereby is authorized, instructed and directed to ~se~t apart in separate fund~ th~ proper pro-rata portion of all sums Of money hereinafter collected, in compliance with the Tax Levy here~knabove set forth for the fiscal year beginning~November 1st, 19J~ and ending October ~lst, 1988, the said amount so authoriZed, directed and instructed to be set aside in separate f~nds to be used exclusive for the ~yment of each individual item of interest on the outstanding Indebtedness and Redemption of the Principal of the Outstanding Indebtedness as~ hereinabove specifically set forth. BE IT FURTP~R ORDAINED: T!~.J~T shovel any word, Words~ pb~rase, pb~rases, figure, figuPes, sub-section, section~ paragra, ph or paragraphs of this 0RDI-NANCE be declared invalid or unconstitutional, the remainder thereof shall not be affected but sb~ll remain in full force and operation. BE IT FURTHER ORDAINED: T~t the passage and adoption of the above and foregoing 0P~DINANCE is urgent and is essential to t~e imm~ediate preservation of the public peace of the T~wn of Boynton, Florida, by reason of the same providing funds for the proper administration of the affair~ of said~Town; and t?~t an emergency does exist for the i~muediate passage and adoption of such ORDINANCE. BE IT FURT~_EH ORDAINED: That the above and foregoing ORDINANCE being and 0P~DIN~NCE fixing a tax rate or making a Tax Levy for the General expenses and IntereSt and Sinking Fund Requirements upon the Indebte~ess of the Town of Boynton, Palm Beach County, FlOrida, for the fiscal year, begir~uing November lat, 19J~, and ending October Glst, 19~, be and the same hereby i~ PASSED AND ADOPTED this Seventh Day of August A.
