T0¥~N OF BOYNTON, PAI~I BEACH COUNTY, FLORIDA, TO REG- UI~TE THE USE OF THE PUBLIC STREETS, ~PARKS AND OTHER PUBLIC PLACES IN TM~ T0i~ 0F BOYNTON BY FEMALE MINORS UNDER THE AGE OF EIGHTEEN YEARS, AND 2~9tLE NINORS UNDER THE AGE OF EIGHTEEN YEARS~ A~ ALL SCHOOL STUDENTS~, AND TO PRO-VIDE FOR THE PROSECUTION FOR VIOLATION OF THIS ORDINANCE AND FOR THE IMPOSITION OF PENALTIES FOR SUCH VIOLATIONS. BE IT ORDAINED BY THE T0~ COMMISSION OF THE TOV~N OF BOYNTON, PAL~ BEACH COUNTY, FLORIDA:- palm1. That the Town Commission of the Town of Boynton, in Beach County, Florida, deems 'it necessary to carry into effect the powers and duties conferred and imposed upon it by law,.and necessary and proper for the good government, order and protection of persons and property in said Town, to regulate the use of the public streets, parks, snd public Places in the Town of Boynton by Female minors under the age Of eighteen years, and male minors under the age of eighteen years, and all school students. 2o It shall be unlawful for any female child under the age of eighteen years and any male'child under, the age of eighteen years, and any school student to loiter, wander, str,ll or be about or in the public streets, park or public places in the Town of Boynton, on foot or in a vehicle of any kind whatsoever after ~the hour of 9:00 o'clock P,M. of any day during the months Of October, November, December~ ~ after the hour January~ February, M~rch, April and May, or of 10:0~ o'clock P.M. on any day during the months of June July, AuguSt, and September, in any year, unless accompanied by a parent or adult member of her or his immediate family, or the adult person having the legal custody ~ and control of such child or except as hereinafter provmde . 3. There shall be a signal given known as the "Curfew signal", which s~ll be the operation of the Fire Siren at 9:00 o'clock P.M. of each day during the months of October, November, December, January, Februa. ry, March, April and ~lay, and at 10:00 o'clock P.~. of each day during the months of .June, July, August and September, and after ~9:00 o'clock P.Me of each day during the months of October, November, December, January, February,~March, April and May, or after the hour of 10:00 o~clock P.M.. of each day during the months of June, July~ August'and September, in any year' all female CHildren under the age 'of eighteen years and all male children under the a~ge of eighteen years and all school students shall be required to be off.all of the public streets, parks and public places of said Town, unless they are in the Company of a parent or an adult member of their in~uediate family, or the adult person having ~he legal custody and control of them as above provided. 4. It shall be unlawful for any parent or adult person having the legal custody and control of any female child under the age of eighteen' years or any male child under the age of eighteen years, to allow, suffer or permit any such male or female child to go or be on or about any public street, park or public place within the ToWn of BOy.nton after the time or in the manner prescribed by Section 2 of this Ordinance. §. Any. policeman, marshal~ constable, peace officer, mayor, member of the Board of Town' Commissioners, or officers of the To.wu Government appointed by the Mayor or the Board of~ Town CoEEissioners, is hereby authorized to take into custody and suGh male or female child violating Section 2 of this ordinance, and for the first violation thereof~ · notify the parent or the. adult person having the legal care and .custOdy of such child, of the violation of this ordinance and the penalty therefor if again arrested, and cause a record to be made of all such violations in the ~Curfew Record~'~ which s~ll be kept accessible at all times in the Tow~ Hall. 6. Upon the second or any Subsequent violation of any of the provisions of this ordinance by any such female child under the age of eighteen years or male child under the age of eighteen ~years, or any School~ student, or by ~the parent or the adult person _having the legal care and custody of any female child under the age of eighteen years or any male child under the age of eighteen years or any school student, the said female child, the said male child, the said school student, the said parent or the adult per- so~ having the legal care or custody of such female or male child, shall be fined not more than $28.00 for each offense, or be imprisoned in the Town Jail for not more than ten days, in the discretion of the Judge of the Mayor's Court of the Town of Boynton~ , Florida. ~. The Mayor in his discretion may issue ~Curfew Exemption Cards~ to 'all childre~ under the age of eighteen years, who are employed' in occupations, or who_may be attending schools of instruction, necessitating the presence of such chilcL121e~ in or abOUt the public streets, parks or public places after the time provided for in Section 2 of this ordinance; such cards shall be issued from the Office of the Town Clerk, and must bear the signature of the Town Clerk, and must bear the signature of A- The Mayor B' The parent or the person having the legal custody of any female of male child under the age of eighteen years. C- The employer, or the superintendent or principal of the school of instruction attended by such child. eighteen years, who are employed in patriotic, civic or recreational occupations necessi, tating the presence of such children in or about the public streets, parks, or public places after the time provided for in Section 2 of this ordinance, provided that ~ children are under the direction of competent superiors not under the age of eighteen years; such Cards shall be issued from the office of the Town Clerk, and must bear the siEnature of A- The Mayor B- The parent or the person having the legal custody of any Child under the age of eighteen years. 'C- The Director in Charge. 9. SUch Curfew Exemption Cards in addition to bearing the signatures described in Section V and 8, sub-division A, B and C, of this ordi.nance, must bear the name of the child under the age of eighteen Years to whom iSsuedj must bear the date of issue, be serially numbered and a complete record kept at the Town Hall. 10. Such'Curfew ExemPtion Cards Shall not be valid after sixty days from the date of their issue unless renewed, and be revoked for 6ause at any time.by the Mayor of the Town of Boynton. 11. It shall be unlawful for any female or male child Under the age of eighteen years or any school student to Whom a Curfew Exemption Card is issued, to.tranSfer, deliver or in any way cause such Curfew Exemption Card to come intothe possession of any other female or male child Under the age of eighteen years or any school Student, and upon any violation of this provision, such male or. female Child making such transfer, deliver or causing Such curfew exemption card to be in the possession of any female or male child Under the. age of eighteen ~ears or any sChOol Student, shall be fined not more than $10.00 for each offense. And further, any child receiving and. using a Curfew ~emption Card issued to any other .child, shall be fined $IO.00 for e~oh offense. 12. All ordinances or parts of ordinances inconsistent with the provisions of this ordinance, be and the same are hereby repealed. 1S. This ordinance shall take effect December let, A. D. 1933.
