BE IT ORDAINED by the Town Commission~ of tho Town of
Boynton, Palm Besch County, Florida~ as follows:
Section 1. DEFINITIONS. The followin~ definitions
sh&!! apply in the interpretation and the enforcement
of this Ordinance:-
(A) ~!~[. ~ilk is hereby defined to be theblacteal
secretion ¢otained by the complete milking of one or
more healthy cows¢ properly fed and kept¢ excluding
that obtained within-fifteen days before and.
days after calving, or such longer oeriod as ~.y be
necessary to render the milk practically colostrum
free; which contains not less than eigb~ and one.half
(8~%)~'°f solids not fat, s~d not less than three and
one-fourth p~eu~cent (~¥~) of milk fat.
(B) ~T_LTK FAT OR B~JTTER FAT. ~ilk fat or butter fat
is the fat of milko
(C) CREA~ Cream is a portion of milk which contains
not less than eighteen per cent (18%) milk~ fat, and
the acidity of ~nich is not more than 0~0%~ expres-
sed as l~otio acid.
(D) SKY_}.'~,~[E~D MII~. S!im~ed milk is milk from which
a sufficient portion of milk has boen removed to r~-
duce its milk fat percentafe to less than
(E) C~0COLATE ~I~, Chocolate milk is milk to which
has been added in a sanitary manner a chocolate

(F) B~TE~d~{ILK. Buttermilk is the product wh_cn

and is approved by tho state health authority.
(J) D~ULTER~TE~ t~LK M~D ~i~ PRODUCTS. Any
stanc~ claimed to be any milk or milk product~de-
fined in this 0rdin~nce~ but not confor~ng with
its definition as given in this Ordinance sh~ll be
deemed adulterated and misbranded,
(K) ~iLK PRODUCER. A milk oroducer is any person
who cyrus or cont~o!s one o~ more cows, a Dart or all
of the milk or mml~ products from which is sold and
d~ .... ~ to anothem person.
(L) ~.~,¢iLK DISTRIBUTOR. A milk distributor is any per-
son v/is_o has in oossession, offers ~o_ sale, sells or
delivers to another any milk or milk products for
consuraption or manufacturing purposes.
(~) DAIR~ 0R DAIRY FAR~(. A dai~ or dairy farm is
any place or pre~ses wheme one or more cows are
kopt~ a part or all of the milk or milk products from
which is sold smd delivemed to any person.
(N) XI~ PL(_,~T. A ~i!k plant is any place, or prem-
ises~ or establishment v~ere milk or milk produts a~e
collectod~ ~ndled, processed, stored~ bottled, pas-
te~ized~ or prepared for distribution.
(0) B~tLTH OFFICER. The term ~health officer~ shall
mean the health authority of the Town of Bo~r~ton~
~] Palm Beach County, Florida, or his ~uthorized
presenta~ive.
(P) AVERAGE BACTERIAL COUS~. Average bacterial
count shall be taken to mean the logaritl~aic av-
erage of the bacterial counts of all samples taken
during the grading periods including at least four
samples taken upon separate dayss provided that in
enforcing Section 9 on Supplementary Regrading the
last four consecutive smuples may be used in
ter~ing sm~ average bacterial count.
(Q) GRADING PERIOD, The grading period shall be such
period of time as the health officer may designate~
within which grade shall be determined for all milk~
cream~ buttermilk and cultured buttermilk suppiiess
provided that the grading period s~a~t in no case
exceed six (6) months.
(R) BACTERCIDE, The term bactercido shall be taken
-~ to mean any bactercidai substance or process approved
by the health officer,
' ' (S) P~RSON, The word ~person~ as used in this Ordi-
nance~ shall mean ~person, firms corporation, or as-
sociation,~
Section 2, THE SALE OF ADJi,TE?~TED OR.,~!SBRAE~ED ~ILK
OR ~i~ PRODUCTS PROHIBITED:
No person shall within the Town of Boynton, PaLm Beach
County~ Fiorida~ or its police jurisdiction prod~_ce~ sell

o_zer, or expose for sale~ or have in possession with in-
wn_c~ ms adu!terated
~ ~- tent to sel!~ any mz!~ or milk product ~' ~ ~ '
or misbrandedo
Section 3. PE~fiT-~. Zt shall be un~aw. Lul any
person to bring into or receive into the Town of Boynton~
.... lm._ Beach County~ Fiorida~ or its ao~ice jurisdiction~
for salo~ or to sol!~ or o_zar fo~ sato ~ o ~
on hand, any milk or milk prods, ct defined in this Ordi-
nance who does not possess a permit from ~e health
of the Town of Boynton~ Palm Beach County,. F!orma~ and
whose vehicle there does not appear in ~ conspicuous place
the 'oermit n~foer in figures at lear three ~nches high
and one and one-half inch~s wi~e.
Such a petit may be rev~R~ by ~_~e l_~alth officer
u-con the violation by the holder of any of the terms of
tn_s Ordinance or in any emergency when in the judgement of
the health officer and mi~ supply in question has become
a public health menace~ -orovided that u~_e ho!me_ of said
petit shalt~ after complying with such revoaation~ have
the right of appeal to the board of b_eaith.
Section 4, Lf~EL!NG ~ND PL~CA~Z~iNG. Ail bott!es~
cans~ packages and other containers enclosing z~mlk or
milk products defined in this Ordinance shall be plainly
!abel~d or marked with (!) the name of ~_e contents as
given in the definition in t__ms Ordinance~ (2) the g~ade
of the contents if said contents are graded under the pro-
visions of tams Ordinance~ (3) the word p~szeur_zed
contents have been masteurized; (4) the wo~ "raw" if the
contents are raw~ (5) the name of the vroeacer or dis-
tributor. The label or ~:~.rk shall be in letters of a
siz~ kind and color approved by the health o_fmce~-and
shall contain no marks or words not approved by the health

being identical with the grading of milk¢ except that 'the
bacterial standard shall be doubled in the case of

CERTIFIED ~LK, Certified milk is milk which conforms
with the current require~nts of the ~morican Association
of Medical ~[i!k Conu~ssions~ and is produced under the
supervision of the ~edioal Co~ssion of

City and C~ty Health Officer of

GRADE ~A" P~%~ ~ILK, Grade "A" Raw ~!ilk is milk the

A certificate signed by the ve.t~rinarian or attested

shall b~ the only valid evidence of the above test. Every
diseased animal shall be removed from tho herd at once and
no milk from diseased cows shall be offsred for sale. All
reacting animals shall bo isolated at once and ~mediatc-
ly excluded from the prs~ses. All animals failing to pass
the T. Bo test shall be branded with the letters

be provided a separate milk houss or milk room for th~ hand-
ling ~d storage of milk and the washing and bact~mc_dal
treatn~nt of milk apparatus and utensils, provided v~th
ti~t floor constructed of concrete or other imosrvious
t~riala~d ~aded to provide proper mramnage~ The walls and
ceilings of tho milk house or room shall h~ of such construc-
tion as to permit easy cloaning~ and shall be painted at least
once sach year, or finished in a m~r ~pproved by the health

T he alternative wordings of Section 8 are offered because
some corm.uunities prefer to use the gradio~ and de-grading
systems of improving milk qua!~ty, whereas others prefer to
use exclusively the system of forbidding the sale of milk
which does not comply with all items of sanitations and in-
stituting court procedure if the violator oersists in sel-
iing~
For those co~maunities which orefer the first method the
following wording of Section 8 should be used.

officer may denature with rennet or some harmless matter
any railk or milk product foomd m~sbrs~aded with respect to
grading or sold without a permit, p~ovided that if tdae con-
ditions warts, ut the milk o~ _~lk products may be destroyed.
- Section 15. P~STE~JRiZATiO~N PROH~XBiTED, No milk or milk
products shall be pasteurized more than once. except as may
be specially permitted by the Health Officer.
Section 16. FD~;UFfE D~iRIES AND MILK PLANTS. All dair-
ies and milk plants from which milk is supplied to the Term
of Boy~aton, Palm Beach County, Florida~ which are he~eazter
constructed, shall conform in their construction to the re-
quirements of the health officer~ which shall not be ].ess

Section 1V-. PEN~'~L. TY. Any person who shall .violate
any provision of this Ordinance shall be fined not more
than one hundred dollars ($100,00), at the discretion of

of this Ordinance shall constitute a separate offense.
Section 18. Pd~PEAL AI~O DA.TE OF EFFECT. All Ordinances
and parts of Ordinances in conflict with this Ordinance are
hereby repealed~ and this Ordinance shall be in full force
