A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING THE GRANT OF 5-FOOT
SIDEWALK EASEMENT AT THE EAST SIDE OF
THE CITY'S EAST WATER TREATMENT PLANT
ON SEACREAST BLVD., SOUTH OF
WOOLBRIGHT ROAD TO PALM BEACH
COUNTY, BEING MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A" ATTACHED
HERETO; AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE THE EASEMENT;
PROVIDING THAT THE EASEMENT BE
RECORDED IN THE PUBLIC RECORDS OF
PALM BEACH COUNTY; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, The Lowe's Home Improvement Center project
received a conditional approval from Palm Beach County Traffic
Engineering due to projected off-site road impacts.
WHEREAS, One requirement for the approval is for the addition of
a second left turn lane from northbound Seacrest Blvd. on to west
bound Woolbright Road.
WHEREAS, The road can only be widened to provide space for
the new lane by obtaining land from the City of Boynton Beach for
sidewalk relocation.
WHEREAS, staff has reviewed this request and recommends to
the City Commission that the City of Boynton Beach grant a 5-foot
sidewalk easement along its property fronting Seacrest Boulevard for a
distance of 550 feet as depicted in Exhibit "A" to Palm Beach County.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton Beach,
Florida by and through its City Commission, does hereby grant the 5-
foot sidewalk easement to the County as described in Exhibit "A"
attached hereto.
Section 2. The Mayor and City Clerk are hereby authorized and
directed to execute the right-of-way easement and the City Clerk to
file the same in the public records of Palm Beach County, Florida.

THIS SIDEWALK EASEMENT, made this ,.~ day of ~ff7~3~',,~ , 2000, between CITY OF
BOYNTON BEACH, a Municipal corporation, as the party of the first part, and PALM BEACH COUNTY, a
political subdivision of the State of Florida, as the party of the second part.
WITNESSETH: That the party of the first part, for and in consideration of the sum of ONE ($1.00) dollar and
other valuable considerations, receipt whereof is hereby acknowledged, hereby grants unto the party of the
second part, its successors and assigns, a perpetual easement and right-of-way over, upon, under, through and
across the following described land, situate in Palm Beach County, Florida, to-wit:
Property more particularly described in Exhibit "A" attached hereto and made a part hereof.
TO HAVE AND TO HOLD THE SAME unto the party of the second part, its successors and assigns forever.
Palm Beach County at its own expense shall maintain the sidewalk easement in a good state of repair. This
document cannot be modified, amended or terminated without the prior written consent of the parties to the
agreement.
