AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION 6. COMMERCIAL DISTRICT
REGULATIONS AND USE PROVISIONS. APPENDIX
A - ZONING. C. C-3 COMMUNITY COMMERCIAL
DISTRICT TO PROVIDE FOR REPAIR OF MOTOR
VEHICLES OR TIRE SALES AND SERVICE IN OUT
PARCELS; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida has determined that it is in the best interests
of the citizens and residents of the City to provide for
repair of motor vehicles or tire sales and service in out
parcels;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Section 6. Appendix - A. Zoning. C-3
Community Commercial District a. Uses permitted, is hereby
amended by adding the words and figures in underlined type and
by deleting the words and figures in struck-through type, as
follows:
C. C-3 COMMUNITY COMMERCIAL DISTRICT.
These district regulations...
1. Uses permitted. Within any C-3
Con, unity commercial district, no
building, structure, land or water shall
be used except for one (1) or more of the
following uses:
a. Any use permitted...
cc: Repair of motor vehicles or tire
sales and service, limited to minor
repairs (see definitions "minor
repairs"), and including car washes as an
accessory use, are as follows:
I) This use is not permitted on sites
less than five (5) acres in size.
2) On sites of greater than five (5) acres
and less than 75 acres, all such uses shall be
located in a shopping center and within the
principal building of the shopping center;
3_~ On sites of greater then seventy-
five (75) acres all such uses will be
allowed to be located in a separate
building in a shoDping center;*

For the purpose of this section,...
Section 2. Ail ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence or word
be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this
ordinance.
