O#980KDINANC~ N0. 98 AN ORDINANCE ABOLISHING A PORTION OF A PUBLIC HiGt~VAY OR STREET Bfl~0~R~ AS THE OCEAN BOULEVARD ~TITHIN THE CORPOP~&TE LIMITS OF THE T0!YN OF BOYNTON, PALM BEACH COUNTY, FLORIDA. BE IT ORDAINED BY THE BOARD OF T0?~i C0~[MISSIONERS 0F THE T0~%~N OF BOYNTON, PALM BEACH COUNTY, FLORIDA, a~ follows:- Section 1. That the said street, highway or boule- Va'rd within the corporate limits of the Town of Boynton, Palm Beach County, Florida, which is located uoon or along the following described right-of-way, situated within the said town, county and state~, to-wit:- Commencing at the intersection of the Center Line of Ocean Avenue and th~.Cen- ter~Line of Cocoa Street (Ocean Boulevard), thence in a southerly direction to the Center Line of Edith Street and-midway between the East Line of Lot l, Block 10, and the V;~est Line of Lot l, Block 3, of the A~ENDED PLAT OF BLOCKS 3, 4~ 5 and 6 OF AX A~[ENDED PLAT OF BLOCK$~ 5, ~, 5 and 6 OF BOYNTON~S SUBDIVISION OF A PART OF T>~ T0~? OF BOYI[TON, which plat was re- corded on the 17th day of May, 1918, in Book No. 6 of Plats at Page No. 58, in the office of the Clerk of the Circuit Court in and for Palm Beach County, Flo- rida; thence southerly midway between the East Line of Block !0 and the ?~est Line of Block 3, to the South Line of Lot 1 Block 9 and the South Line of Lot 1 Block ~, of the A~iENDED PLAT OF BLOCKS 3, 4, 5 and 6 0F AN A~ENDED PLAT OF BLOCKS 3, 4, 5 and 6 OF BOYNTON~S SUBDIVISION OF A PART OF THE T01~ OF BO~q~iT0~I, which plat was recorded on the 1Vth day of ~ay, 1916, in Bbok No. 6 of Plats at Page No. 58, in the office of the Clerk of the Circuit Court in and for Palm Beach County,Florida. be, and the same hereby is, condemned, closed and abolished. Section ~. That, that certain road, street, boule- yard or highway beginning at the intersection of the Center Line of Ocean ~venue and the Center Line of Cocoa Street (Ocean Boulevard); running thence in a Southerly Direc. ti0n to the Center Line of Edith Street and midway between the East Line of Lot l, Block 10, and the ~J~est Line of Lot l, Block ~, of AN A~EhrDED PLAT OF B0¥NTON'S SUBDIVISION, according to the plat thereof filed on the 17th day of Nay, 1918, in Book No. 6 of Plats at Page No. 58, in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida; thence running in a Southerly direction midway between the East Line of Lot l, Block,~ 9, and the ~¥est Line of Lot l, Block ~, of AN A~ENDED PLAT OF B0~ZNT01~S SL~BDI- VISION, to the South Line of Lot l, Block 9, and the South Line of Lot l, Block ~, of AN ANE~DED P~T OF B0¥NTON~S SUBDIVISiON,~ according to the plat thereof filed on the 17th day of ~ay, 1918, in Book No. 6 of Plats at Page No. 56, in~ the office of the Clerk of the Circuit Court in and for Falm Beach County, Florida; which road, highway, street or boulevard is kno~wn and called, "The Ocean Boulevard", be and the same hereby is, discontinued, abolished, closed and delcared to be no longer a publis thoroughfare. Section Z. That this ORDINANCE and s~ll the pro- visions hereof shall become effective ten days after its passage by the Board of Town Commissioners of the Town of Boynton, Palm Beach County, Florida. Section ~. That~ immediately after the 0RDI~.NCE Becomes effective under the provisions hereof,~ it shall be the duty of the Chief of Police of the To~ of Boynton, Palm Beach County, Florida, and any assistants v~hich he may deem necessary, to blockade and obstruct, by proper methods and means, the southern and northern terminals of the Ocean Boulevard~ which is described and abolished by the terms of this ORDINANCE, and to close the same from traffic of every nature whatsoever; and upon the obstruction and closing of the said boulevard as herein provided, any person, aggregation, of persons, firm or corporation v~ho shall remove the obstruction so placed in and upon the said boulevard, shall be guilty of vio- lation of this 0RDIN~NCE, and upon conviction therefor~;~ shall be punished by a fine not exceeding Five Hundred (~00.00) Dollars or by imprisonment in the Town bastile, at hard labor for the Town of Boynton, Palm Beach County, Florida, by a term not to exceed ninety (90) days, one or both. Section 8. That all 0RDIN~CES and RESOLUTIONS, and parts of 0RDIN~kNCES and RESOLL~IONS of the Tov~a of Boynton, Falm Beach County, Florida, which are in conflict with t~is 0RDI~ANCE, or any part hereof, are h~ereby expressly repealed~ nullified and held for naught. ~ne above ORDINANCE N0. 98 having been read in full at a Regular ~eeting of the Board of To~.~n Commissioners of the To~n of Boynton, Florida, held on the ~venty-first day of August Ao D. 19~8, was adopted and passed at a Regular ~eeting of the Board of To~n Commismioners held on the Fourth day of September A.
