O#83 ORDii~ANCE 1~0. 83 AN ORDIi~'ANCE TO _~GULA~E A~D PREVENT DOGS FROi¥[ RU~[I~iNG AT LARGE, AND TO PROVIDE FOR THEIR DESTRUCTION · BE IT ORDAINED BY T~FE T O~VN CO~[~iSSION OF T~ TO~f OF BOT~[TON, FLORIDA:- seCtion 1. That it shall be unlawful to permit am~y dog to run at large, unaccompanied by its owner, possessor ~or.~harborer, or by his or her representative in any street or public place, within the corporate limits of the Town of Boynton, Florida. Provided that no dog shall be deemed to be at large, within the visions of this ordinance, while upon the property of the owner, possessor or person who harbors it, or upon the property of a neighbor who shall consent thereto. Section 2. That the owner, possessor or harborer of every dog shall take out a license for such dog from the Town Clerk, of said Town of Boynton, Florida, which license shall show the number of the iie-ense~ the name of the licensee, and the breed, color aud..sex of the dog; and each dog so licensed shall wear a collar arc,mad the neck, having engraved upon a:.meta! surface thereto, or attached thereto, the name of the licensee and the registered number of said dog. Every dog' not .'~o licensed, and not wearing a cotiar~ marked as herein provided, shall be deemed to be at large when found on any street or ~ubiic place within said Town, whether accompanied or not by the owner, possessor or ~arborer of said dog or his or her representative and shall be liable to seizure as herein provided. Each owner of a dog shall pay a license tax of ONE DOLLAR (~1o00)o Each o~mer of a bitch shall pay a license tax of FIVE DOLLARS (~5.00) The license tax under this section must be paid to the Totem Clerk of said Town before the Certificate of Registration and License is issued, and said license taxes so collected shall be deposited in the General Fund of said Town. Section 3. AND BE IT FDZaTi~ER 0F~DAINED, that all dogs running at large, in the manner aforesaid, whether - licensed or not, shall be seized~ captured and de- livered by such person or persons as may be designated by the B. oard of To~.~n Commissioners, of the Town of Boynton, Florida, for that purpose, and only such dogs, whose owners, ~ossessors, or harborers have complied with-Section 2, of this O'rdinance;' sh~ll be detained for the space of ~venty-four hours, and if not Claimed or redeemed by the owner, possessor or person harboring same, or some other person, within twenty-four hours thereafter, and by owner paying a penalty of TWO DOLLARS (;~2.00)', shall be killed and destroyed in such manner and by such person or persons as said Board of Town Commissioners may designate. Provided, that whenever the name of any person appears on the collar of any dog seized, under this Ordinance, such pets on shall forthwith be notified of the se2~ure in writing, by postal card duly addressed to him or her and deposited in the Post Office~ Any monies received from such fees Shall be paid to the To'~a~ Treasurer for the use of said Town° Every dog seized and 'unredeemed within the time and u~der the conditions herein described shall be kil!ed~ and the carcass shall be buried by Such person as shall be appointed by the Board of Tow~ Commissioners. . ~-~E that no Section ~ ~D BE IT FLy, tiTHER ORDA±~D~ person slaail hinder or molest any person or persons so appointed by the Board of Town Commissioners~ while engaged in seizing or capturing and such dog~as afore- said~ or in performing any other duty intended by the propulsions of this Ordinance, u~der a per~alty of not less than FIVE or more than T~NTY-i'~gE DOL~&RS for each and every offense, to be imposed upon the com- plaint of any person so hindered or molested. Section ~. The provisions of this Ordin~nc~ shall not appl'~ to dogs temporarily in or passing through said Town when accompanied by their nor~ resident owners, possessors or harborsrs~ Se~tio~ V~ it shall not be lawful for any person or persons~ having knowledge of the bad or vicious habits of any dog~ whether male or female, and of which such perso~ or persons shall be the owner~ or custodian, to permit such dogs to r~ at large on the public streets or places of the Town of Bo~nton~ Florida~ ~nder a penalty not exceeding TEN DOL~RS for each and every offense Section 8. if any dog has bitten or muti- lated any person or persons, horse, cow, sheep or other animal in any public place or thoroug~hfare it shall be the duty of the ~v~ayor;and he shall have the power, to direct the Chief of Police to demand such dog, after such biting or mutilating, or an attempt so to do, of the owner or custodian thereof, for the purpose of killing or destorying the same; and in the case of refusal or neglect on the part of such o~aer or custodian shall have an opportunity to be heard in defense of said dog, and show cause shy s~ch killing should not take place~ said dog the meantime to remain in the custody of the Police Department of said Town. Section 8. It shall be lawful for the Board of Town Conmmissioners of said Town at amy tiem, when in its ~pinion the public safety may require it, to issue its proclamation authorizing the destruction of all dogs, male or female, fot~d running at large within the limits of said Town, except such as shall be properly mmzzted with a wire or leather muzzle about the nose, securely fastened~ after one day's public notice by written or printed bulletin or handbill; ~provid~d that nothing in said proclamation shalZ'~'appiy to a dog or dogs of ~ non-resident passing through the said Town accompanied by the owner or owners, custodian or custodians of such dog or dogs; and may thereupon appoint one or more persons o~ said Town, with full power and authority to kill any dog,' male or female, found running at large without such muzzle within said Town, or said dog or dogs may be impounded, disposed of or killed by said person?~or~ p~rsons in the manner provided in the third Section of this Ordinance. Sec.tion 9. No dog or dogs, male or female, shall be permitte~ to run at large through the business portions of said Town, or through the streets or market places thereof~ under a penalty of TE~ DOLLARS (~10.00) for each and every offense; and such dog or dogs shall be considered to be at large unless fastened to a tether held by the owner or custodian of such dog or dogs. And the owner or custodian of such dog or dogs shall not permit the same to commit any nuisance while so tethered or fastened~ under a like penalty. S~ction I0o BE IT ~-%~RTHER ORDAINED that the passage of the above and foregoing Ordinance is urgent and is essential to the immediate preser- vation of the public peace and safety of said Town of Boynton, Florida, and that an emergency does exist for the immediate adoption of such Ordinance. Section 11. BE iT FURTH~R ORDAINED that all Ordinances, Resolutions or Orders or parts of Ordinances, Resolutions or 0rd~rs inconsistent or in conflict herewith be, and the same are hereby, rescinded and' repealed. Section 12. BE IT FURT~R 0.~qDAINED that the above and foregoing 0rdi~amce be~ and the same hereby is, passed and adopted on this 8th day of July, A. D. 1927, being a Regular lvieeting of 'the Board of Town Commissi oners of the Town of Boynton~ Florida, and being the meeting at which same was introduced; and further that such Ordinance shall become effecti~e innnediate!y.
