75-WWWRESOLUTION NO. 75-W-WW A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, VACATING AND ABANDONING A PUBLICALLY DEDICATED ALLEY RIGHT OF WAY. WHEREAS, the City Council of the City of Boynton Beach, Florida, has received a petition from the owner of the land described hereinafter for the adoption of a resolution vacating and abandoning that certain alley presently lying in and upon said lands; and WHEREAS, subject abandonment has heretofore been considered by the Planning and Zoning Board of the City of Boynton Beach, Florida, and a favorable recommendation has been rendered in connection therewith; and ~HEREAS, after thorough public investigation and public hearing on said abandonment, it appears that no hardship will be occasioned by such abandonment, that said abandonment will be for the best interests of the general public, and that no valid reason exists why same should not be vacated; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, PLORIDA: Section 1: That the alley lying in and upon the following described land in Palm Beach County, Florida, to-wit: The alley between Lots 22 and 23, Block 12, Boynton Heights Rev. Plat, Recorded in Plat Book 10, Page 64, Palm Beach County Records and the South 25 feet of Lots 4 and 5, Block 6, Boynton Heights (Original), more particularly described as: The east 117.5 feet of dedicated alley 10.5 feet in width, Block 12, Revised Plat of Boynton Heights Addition to the Town of Boynton, Florida, according to the plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, in Plat Book 10, page 64, is hereby vacated and abandoned, and such area is hereby returned to acreage for purposes of taxation.
