75-NNN SOLUTION NO. n A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, URGING THE LEGISLATURE OF THE STATE OF FLORIDA TO ENACT LEGISLATION THAT WOULD CORRECT THE I~QUITIES NOW EVIDENT WITH RESPECT TO THE ROAD AND BRIDGE FUND CREATED BY CHAPTER 33 6 , FLORIDA STATUTES , AND THE CONTROL OF COUNTY BUDGETS AS SET FORTH IN CHAPTER 129, FLORIDA STATUTES. WHEREAS, the Laws of the State of Florida create and set forth the fundings and .limitations thereon of the County Road and Bridge Fund; and WHEREAS, the Laws of the State of Florida establish budgeting procedures for the several County Commissions throughout the State; and WHEREAS, the City Council of the City of Boynton Beach in Palm Beach County, Florida~ has taken note that there are abuses in both the preparation of the County budget and the distribution of the County Road and Bridge Funds assigned to municipalities; and WHEREAS, one specific abuse is the budgeting of massive amounts of road and bridge construction work in other than the Road and Bridge Fund to avoid equitable distribution of County taxes to municipalities; and WHEREAS, the County officials of Palm Beach County do not distribute funds allocable to the municipalities in the County on a timely basis and thereby deny either use of the funds by the municipality or the accrual of interest by these municipalities; and WHEREAS, the Legislature of the State of Florida has both the power and the duty to correct these abuses; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: ,S.ection 1: That the Legislature of the State of Flori is implored to modify Section 336.59 of the Florida Statutes to affect a timely distribution of the funds accruing to municipal credit as set forth in Subparagraph 2 of this Subsection. It is suggested that the Road and Bridge Funds accruing to municipal credit be distributed by the County Commissions throughout the State in accordance with the guidelines established in Section 197.016 of the Florida Statutes. Section 2: That the Legislature be implored to modify Chapter 129 of the Florida Statutes to ~equire the several County ions throughout the State to provide for the construction and maintenance of County roads and bridges only in the County and Bridge Fund since many Commissions throughout the State regularly construct massive road and bridge projects in the Capital Fund and thereby escape the legislative intent that tax collected for road and bridge construction purposes would shared with the municipalities in order that the municipal road bridge system could be maintained partially with monies col- lected from municipal residents for a road system.
