75-JJJRESOLUTION NO. 75-~7'¢T~.T A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, VACATING AND ABANDONING CERTAIN UTILITY EASEMENTS. WHEREAS, the City Council of the City of Boynton Beach, Florida, has received a petition from the owner of the land described hereinafter for the adoption of a resolution vacating and abandoning certain utility easements presently lying in and upon said lands, to-wit: The East 6 fee~ of Lots 1, 2 and 3, BOYNTONBOROUGH, recorded in Plat Book 25, Page 174, Public Records of Palm Beach County, Florida; and WHEREAS, subject abandonment has heretofore been considered by the Planning and Zoning Board of the City of Boynton Beach, Florida, and a favorable recommendation has been rendered in connection therewith, excepting the South 6 feet of said Lot 1; and WHEREAS, after thorough public investigation and public hearing on said abandonment, it appears that no hardship will be occasioned by such abandonment as recommended by the said Planning and Zoning Board, that said abandonment will be for the best interests of the general public, and that no valid reason exists why same should not be vacated; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the utility easements lying in and upon the follow- ing described land in Palm Beach County, Florida, to-wit: The East 6 feet of Lots 1, 2 and 3, BOYNTONBOROUGH, excepting, the South 6 feet of Lot 1, as recorded in Plat Book 25, Page 174, Public Records of Palm Beach County, Florida, are hereby vacated and abandoned, and such area is hereby returned to acreage for purposes of taxation.
