A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BOSTON BEACH, FLORIDA, VACATING AND At~N-
DONING CERTAIN PUBLICLY DEDICATED RIGHTS-OF-
9~%Y AND UTILITY EASEMENTS.
WPEREAS, the City Council of the City of Boynton Beach,
Florida, has determined that the vacating and abandoning~ of cer-
tain publicly dedicated rights-of-way and utility easements lying
in and upon the land hereinafter described will be in the best
interests of the residents of said City; and
WHEREAS, subject abandonment has heretofore been considered
by the Planning and Zoning Board of the City of Boynton Beach,
Florida, and a favorable recommendation has been rendered in
connection therewith; and
W~HEREAS~ all abandoned public utilities have been contacted
for their recommendations in connection with said abandonment, an(
their recommendations have been received; and
WHEREAS, after thorough public investigation and public
hearing on said abandonment, it appears that no hardship will be
occasioned by such abandonment, that said abandonment will be for
the best interests of the general public, and that no valid
reason exists why same should not be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That those portions of the publicly dedicated
rights-of-way and the utility easements lying in, upon, over and
across the following described land in the City of Boynton Beach,
Palm Beach County, Florida, to wit:
190.50 feet of Northeast Eighth Avenue (Orange
Street) as measured westward along the north
right-of-way from the west right-of-way ~f
Northeast Third Street (Australian Boulevard),
including that certain 40-foot right-of-way
in the plat of AR~..~EN' PARK SUBDIVISION, as re-
corded in Plat Book 2, page 96, Public Records
of Palm Beach County, Florida$
are hereby vacated and abandoned, and such areas are hereby
returned to acreage for purposes of taxation.
PASSED AND ADOPTED this ~ day of May, A.D., 1974.
