A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA,
VACATING AND ABANDONING A CERTAIN UTILITY EASEMENT.
WHEREAS, the owner of the land as hereinafter described
has petitioned the City Council of the City of Boynton Beach,
Florida, for the adoption of a resolution vacating and abandoning
a certain utility easement presently lying in and upon said
lands; and
~r~EREAS~ as a sUbstitute utility easement, the owner 1of
the land~ as hereinafter described~ has granted and conveyed to
the Cit/f of BOynton Beach a utility easement in and upon the
following land in Palm Beach County, Florida, to-wit:
The East 10 feet of the West 45 feet of Lot 27,
Block 5, Lake Boynton Estates~ Plat 1, Beynton
Beach, Florida, as recorded in Plat Book 13 on
Page 32 Public Records of Palm Beach County~
Florida, less the South 80 feet thereof together
with the East 10 feet of the West 45 feet of Lot
24 of said Block 5, less the North 85 feet thereof;
and the South 10 feet of lots 24 and 25 of said
Block 5, less the East 5 feet thereof;
and
WHEREAS, said petition has heretofore been considered by
the Planning and Zoning Board of the City of Boynton Beach~
Florida~ and a favorable recommendation has been rendered in
connection therewith; and
WHEREAS~ said petition for abandonment is deemed to be
reasonable and in the best interests of the inhabitants of the
City of Boynton Beach, Florida;
NOW, THEREFORE~ BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH~ FLORIDA:
Section 1: That the utility easement lying -~in and upon
the following-described land in Palm Beach County~ Florida,
to-wi t:
The West 75 feet of the Easement~ for Public Utilities
lying between lots 24, 25,.~! ~i~.~a~d?i~ 27, Block 5, according
to the Plat of Lake Boynton Estates, Plat 1, Boynton
Beach~ Florida, as recorded in Plat Book 13 on Page 32
Public Records of Palm Beach. County~ Florida~
is hereby vacated and abandoned~ and such area is hereby returned
to acreage for purposes of taxation.
