CONSIDERATION OF
BSTABLISHMENT OF REGIONAL WASTEWATER
TREATMENT AND DISPOSAL FACILITY
WHEREKS, the~P'alm Beach County Water Quality'Management Plan, as
adopted by the Area Planning Board of Palm Beach County on October 17,
1973 and accepted by the State of Florida Department of Pollution
Control and the United States Environmental Protection Agency, estab-
lishes a regional wastewater pollution control service area, encompassing
the principal municipalities of Delray Beach and Boynton Beach, and
certain contiguous municipalities and unincorporated areas; and
WHEREAS, the Water Quality Management Plan sets forth an imple-
mentation schedule for establishment of needed pollution control
facilities, which schedUle must be met in accord with federal and state
requirements to achieve federal and state pollution control objectives
and standards; and
WHEREAS, the said Water Quality Management Plan and the Federal
Water Pollution Control Act, Amendment of 1972 (Public Law 92-500)
requires the establishment of a regional wastewater treatment and
disposal facility to assure implementation of ~ederal and state pollution
control objectives and standards; and
WHEREAS, the principal municipalities affected by federal and
state pollution control objectives and standards are in need of federal
grant assistance from the United States Environmental Protection Agency
in order to implement said requirements of the Palm Beach County
Water Quality Management Plan; and
WHEREAS, to be eligible for grant assistance from the United ~tates
Environmental Protection Agency, a regional wastewater treatment facility
must be established, or in the process of being established, prior to
grant application and that detailed contracts and other agreements per-
taining to the promulgation, management and operation of such facility
are recognized by the principal municipalities as being essential to
the establishment of such facility.
NOW, THBREFORE BE IT RESOLVED BY THE CITY: COUNCIL OF
BOYNTON BEACH, FLORIDA:
Section 1. That a public hearing on behalf of the City of
Boynton BeaCh,.jointly with. and on behalf of the City-of Delray BeaCh,
be held in thecafeteria of Atlantic High School on Seacrest Boulevard,
at 7:50' pm, Monday, December 17, 1975, for the purpose of considering
the establishment of a regional pollution control facility for
treatment and'disposal of wastewaterfrom their respective service
areas.
SectiOn 2. That John'R. Maloy, Chairman, Area Planning Board of
Palm Beach County, or a designee, be authorized to conduct said public
hearing.
Section 5. That the City Council of Boynton Beach herewith
.agrees to work in good'faithWith the City Council of Delray Beach in
accordance with.all federal and state requirements and the general
principals~d concepts of the Palm Beach County:.Water'Quality Management
Plan to establish a regional wastewater treatment and disposal facility.
Section 4.~ That during the interim period prior to formalization
of contracts'and agreements that may be needed to assure promulgation
of the facility, the City Council of Boynton Beach hereby authorizes
its designated representative, the Mayor~ or in the absence of the

to-co-sign withthe authorized'representative of the City of Delray Beach,

a regional wast~w'ater~r-e~atment and disposal facility. ·
Section 5. That as a demonstration of good faith and assure due
progress in complying with federal and state pollution control objectives
and standards, the CityCouncil of Boynton Beach will cooperatewith
the City Council of Delray Beachand with the assistance of the re-
spective administrative officials, consultants and advisors in expediting

th~' needed workshops and meetings to formulate'the neeessary legal,
fiscal, engineering and management guidelines and.agreements as may
be required to. establish'an effective regional wastewater treatment
and disposal facility.
Section 6. That the'City Clerk of the City of Boynton Beach
is hereby authorized'and'instructed to place a legal notice of
public hearing in accordance withthe provisions of this Resolution.
