AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 10. GARBAGE, TRASH AND
OFFENSIVE CONDITIONS, ARTICLE II,
SECTION 10.29 OF THE CODE OF ORDINANCES
OF THE CITY OF BOYNTON BEACH, TO
ESTABLISH RATES AND CHARGES FOR CITY
SERVICES; PROVIDING THAT EACH AND EVERY
OTHER PROVISION OF CHAPTER 10 NOT
SPECIFICALLY AMENDED HEREIN SHALL REMAIN
IN FULL FORCE AND EFFECT AS PREVIOUSLY
ENACTED; PROVIDING FOR AN IMPLEMENTATION
DATE; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, Palm Beach Solid Waste Authority has changed
~he tipping fee for waste disposal; and
W~ER~AS, a new rate structure has been put into effect
~ith regard to yard waste; and
W~EREAS, the City of Boynton Beach annually establishes
Sanitation budget and establishes Sanitation rates to
generate funds for the budget; and
W~ERW4%S~ it is necessary to amend the residential and
~ommercial sanitation rates to reflect these changes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Chapter 10, Garbage, Trash and
Offensive Conditions, Article II, Section 10-29, paragraphs
A.1, and D. are amended by adding the words and figures in
underlined type and by deleting the words and figures in
struck-through type as follows:
Sec. 10-29. Rates and charges for city service.
The following rates and charges sh~ll be for refuse
collection service provided by the citv.

Container rental charge - A monthly charge to
cover the actual cost of the container
(amortized over five (5) years) as annually
calculated and certified by the City
Commission. The certified container rental
charge will be as follows:
2 cu yd container - $3.95 per month
3 cu yd container -
4 cu yd container -
6 cu yd container -
4.85 per month
5.43 per month
7.37 per month
8 cu yd container - $8.25 per month
Disposal charge - a fixed charge per cubic
yard as charged by the Palm Beach County
Solid Waste Authority for,disposal of waste
at the landfill as annually calculated and
certified by the City Commission. The amount
certified as the disposal charge is

Dollars per ton.
Operating charge - A fixed charge per cubic
yard to cover the operating cost less
disposal cost. The operating charge will be

cents ($2.50) per cubic yard per pick-up per
month.
Capital equipment charge - A fixed charge per
pick up to cover total capital costs for
vehicles as annually calculated and certified
by the City Commission. The certified

Overhead charge - The monthly overhead charge
will be a fixed charge of Fourteen dollars
per month per

D. Residential rates (containerized):
1. ~ght Six dollars ~$8~88~ ($6.00) per month
for each family unit for apartment and
condominiums that are served by high volume
containers (containerized).
2. E~ght Six dollars ~$8~88~ ($6.00) per trailer
in trailer parks.
Section 2. That each and every other provision
of Chapter 10. Garbage, Trash and Offensive Conditions.,
Article II, not specifically amended herein shall remain in
full force and effect as previously enacted.
Section 3. That the new rates and charges for city
services will become effective on October 8, 1992.
Section 4. That all ordinances or parts of ordinances,
~r resolutions in conflict herewith be and the same are
hereby repealed.
Section 5. Should any section or provision of this
Drdinance or portion hereof, any paragraph, sentence, or
~ord be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
Section 6. Authority is hereby gran'ted to codify said
ordinance.
Section 7. This ordinance shall become effective
immediately upon passage.
