A RESOLUTION OF THE CITY OF BOYlqTON BEACH,
FLORIDA, VACATING AND ABANDONING A CERTAIN
UTILITY EASEMENT, SUBJECT TO DEDICATION OF
A REPLACEMENT UTILITY EASEMENT.
WHEREAS, the owner of the land hereinafter described has
petitioned the City Council of the City of Boynton Beach, Florida,
for the adoption of a resolution vacating and abandoning that
certain utility easement described as follows:
That certain easement, being 12.0 feet in width,
lying between Lots 25 and 26, together with certain
easement, being 12.0 feet in width, lying between
Lots 24 and 26, less that part lying across the
North 6.0 feet of said Lot 24, all in Block 41,
ROLLING GREEN RIDGE FIRST ADDITION, Boynton Beach,
Florida, as recorded in Plat Book 24, Page 226,
Public Records of Palm Beach County~ Florida;

WHEREAS, the owner of said land has agreed to dedicate a
replacement utility easement along and upon other land owned by
said owner, to wit:
%~ne South 10 feet of the North 35 feet of Lot 26,
Block 41, ROLLING GREEN RIDGE FIRST ADDITION,
Boynton Beach, Florida, as recorded in Plat Book
24, page 226, Public Records of Palm Beach County,
Flor ida;
and
WHEREAS, said petition for abandonment and said agreement for
replacement utility easement have heretofore been considered by
the Planning and Zoning Board of the City of Boynton Beach, Florida
and a .favorable recommendation has been rendered in?~con~e~tion
therewith; 'and
WHEREAS, said petition for abandonment and said agreement to
dedicate the replacement utility easement are deemed to be reason-
able and in the best interests of the inhabitants of the City of
Boynton Beach, Florida;
NOW, ~IEREFORE, BE IT R~SOLVED BY THE CITY COUNCIL OF THE CITY
D~E BOYNTON BEACH, FLORIDA:
Sectional: That the following described utility easement, to
wit:
That certain easement, being 12.0 feet in width,
lying between Lots 25 and 26, together with certain
easement, being 12.0 feet in width, lying between
Lots 24 and 26~ less that part lying across the
North 6.0 ~feet of said Lot 24, all in Block 41,
ROLLING GREEN RIDGE FIRST ADDITION, Boynton Beach,
Florida, as recorded in Plat Book 24~ Page 226,
Public Records of Palm Beach County, Florida;
is hereby vacated and abandoned and is hereby returned to acreage
for purposes of taxation, subject, however, to the condition that
the said owner dedicate a replacement utility easement along and
upon the following described land, to wit:
The South 10 feet of the North 35 feet of Lot 26,
Block 41~ ROLLING GREEN RIDGE FIRST ADDITION,
Boynton Beach, Florida, as recorded in Plat Book
24, page 226, Public Records of Palm Beach County,
Florida.
