AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
REZONING A CERTAIN PARCEL OF LAND WITHIN
THE CITY OF BOYNTON BEACH, FLORIDA FROM
R-2, (DUPLEX RESIDENTIAL) TO C-2
(NEIGHBORHOOD COMMERCIAL), AMENDING THE
REVISED ZONING ¥~P ACCORDINGLY;
PROVIDING A CONFLICTS CLAUSE, PROVIDING
A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WH~R~A$~ the City Commission of the City of Boynton
~each, Florida, has heretofore adopted Ordinance No. 91-70,
in which a revised Zoning Map was adopted for said City; and
W~EREAS, Christopher Cutro, Planning Director and agent
~or the City, has heretofore filed a Petition with the City
)f Boynton Beach, Florida, pursuant to Section 9 of Appendix
k - Zoning, of the Code of Ordinances, City of Boynton
~each, Florida, for the purpose of rezoning a certain parcel
)f land consisting of approximately 1.51 acres located
~ithin the municipal limits of said City, said property
)eing more particularly described hereinafter, from R-2
Duplex Residential) to C-2 (Neighborhood Commercial); and
W~EREA$, the City Commission deems it to be in the best
Lnterest of the inhabitants of said City to amend the
~foresaid Revised Zoning Map as hereinafter set forth~
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
)F THE CITY OF BOYNTON BEACH, FLORIDA, T~L~T:
Section 1. The following described land, located in
~he City of Boynton Beach, Florida, to wit:
That part of the southern 300 feet of
the east 1/2 of southeast 1/4 of
southwest 1/4 of southeast 1/4, north
and east of abandoned Old Boynton Road
right-of-way, in Section 20, Range 43,
east, and Township 45, south, of the
Public Records of Palm Beach County,
Florida, containing 0.86 of an acre,
more or less, also,
Section 2. That the aforesaid Revised Zoning Map of
~he City shall be amended accordingly.
Section 3. That all ordinances or parts of ordinances
Ln conflict herewith are hereby repealed.
Section 4. Should any section or provision of this
rdinance or portion thereof be declared by a court of
ompetent jurisdiction to be invalid, such decision shall
lot affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify said

Section 6. This ordinance shall become effective

neighborhood. The vacant outparcel which lies along the east
side of Palm Beach Leisurevlle Should be limited to either
single-family residential use, with a maximum density comparable
to the adjacent portion of Leisurevlle, or to a low-intensity
institutional use.
7.b. ~ioneer Canal Park Addition'
Two platted lots have been added to the eastern side of Pioneer
Canal Park, and are thus shown in the Recreational land use
category. Since governmental uses are permitted in the current
R-lA zoning district, it will not be immediately necessary to
rezone these lots to the Recreation zoning district.
This 104-acre parcel is shown on the Future Land Use Plan as
Moderate Density Residential (7.26 dwellings per acre). With
development of the Boynton Beach Mall directly to the west, the

development of the other two corners of this intersection for
commercial use, there will be increased pressure to develop this
property for commercial use. Commercial land uses should not be/
permitted on this property since adequate commercially-zoned lagd
already exists to accomodate existing and projected demand, and\~
~cause commercial land uses would create an unacceptable impact
roads in the vicinity. Since there are few large industrial
sites in the City, this is also a possible site for one or more
imajor manufacturing plants.
