AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 4 OF THE CODE OF
ORDINANCES, ANIMALS AND FOWL, TO PROVIDE
FOR PROSECUTION OF VIOLATIONS;
PROVIDING AUTHORITY TO ISSUE NOTICES TO
APPEAR; PROVIDING FOR CODIFICATION,
CONFLICTS, SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Boynton
Beach deems it necessary and in the best interests of the
citizens of Boynton Beach to provide the City's Animal
Control Officers with the power to issue a notice to appear,
establishing fines and requiring appearances before the
County Court,
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Chapter 4, entitled "Animals and Fowl of
the Code of Ordinances of the City of Boynton Beach" is
hereby amended to add a new Section, 4-41 shall read as
follows:
Section 4-41 entitled "Violations; Notices to Appear
Enforcement":
(a) Any violation of any provision of this Chapter of
the Code of Ordinances is a misdemeanor of the second
deqree;
Cb) Any person who has committed an act in violation
of Chapter 4 of the Code of Ordinances shall receive a
notice to appear from the animal control officer or a
law enforcement officer who has probable cause to
believe that the person has committed a misdemeanor of
the second deqree in violation of any provision of
Chapter 4 of the Code of Ordinances;
(c) The County Court shall have jurisdiction over ali
violations of this ordinance;

Section 2. That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.
Section 3. Authority is hereby granted to codify
said ordinance.
Section 4. This ordinance shall become effective
immediately upon passage.
