A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, VACATING AND ABANDONING A PORTION
OF~i'~BIG BASS WATERWAY~ SUBJECT TO CONDITIONS
REQUIRED BY PALM BEACH COUNTY.
W=~E~EAS, Milnor Corporation has petitioned the City Council
of the City of Boynton Beach, Florida for adoption of a resolu-
tion vacating and abandoning that portion of Big Bass Waterway
extending from the Easterly right-of-way of Congress Avenue and
lying between Lots 24 through 31, inclusive, Block 13, and Lots
50 through 58, inclusive, Block 19t which ~Lots respectively bor-
der S. W. 27th Avenue and S. W. 26th Avenue, all located in Golf
View Harbour Subdivision, Second Section, as recorded in Plat
Book 27, pages 46 and 47, Public Records of Palm Beach County,
Florida; and
WHEREAS~ said request has heretofore been considered by the
Planning and Zoning Board of the City of Boynton Beach, Florida,
and a favorable recommendation has been rendered in connection
therewith; and
WHEREAS~ all affected public utilities have been contacted
for their recommendations in connection with said request, and
their recommendations have been received; and
WHEREAS, the County' of Palm Beach~ Florida, has stated that
it is agreeable to the proposed abandonment subject-to certain
conditions set forth in Exhibits A and B attached hereto and
made a part hereof; and
WHEREAS, said request for abandonment is deemed to be reason-
able and in the best interests of the inhabitants of the City of
Boynton Beach, Florida, subject to those certain conditions
required by the County of Palm Beach, Florida, as set forth in
said Exhibits A and B attached hereto;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF BOYI~TON BEACH,
FLORIDA:
_Section 1: That the said portion of Big Bass Waterway
extending from the Easterly right-of-way of Congress Avenue and
lying between Lots 24 through 31, inclusive, Block 13, and Lots
50 through 58, inclusive, Block 19~ which Lots respectively bor-
der S. W. 27th Avenue and S. W. 26th Avenue, all located in Golf
View Harbour Subdivision, Second Section, as recorded in Plat
Book 27, pages 46 and 47~ Public Records of Palm Beach County,
Florida, is hereby vacated and abandoned and is hereby returned
to acreage for purposes of taxations subject, however~ to those
certain conditions of the County of Palm Beach~ Florida, as set
forth in Exhibits A and B attached hereto and made a part hereof.

In reference to yours of April 19~ 1973~ please be advised that this office
has considered the proposal contained therein~ and finds it to be agreeable
subject to the fol!owingconditions:

That ten (10) feet of right of way east of and
contiguous to Congress Avenue as it affects the
petitioner property be dedicated to the County.
That an easement at least twelve (12) feet in'
width be deeded to Palm Beach County in order to
perpetuate the function of'Big Bass Waterway and ~.
to properly drain Congress Avenue.
That catch basin and culvert be constructed from
the west side of Congress Avenue to .Big Bass Waterway
and~that the system be designed by a registered
engineer to drain the affected section of Congress
Avenue and to provide drainage of the flue on
the west side of Congress Avenue. It should be
noted that the drainage map and drainage computations-
for the aforementioned design must be submitted to
this office for review and approval.
That if the replat is to be recorded prior to the
completion of construction of the outfall system,
surety in the amount of the estimated cost of
