A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA,
VACATING AND ABANDONING A DEDICATED 20-FOOT RIGHT-
OF-~AY BUT RESERVING A UTILITY EASEMENT THERETO.
WHEREAS, the owners of Lots 2~ 3, 6~ 7, 10 and 11, Block 2,
Roberts Addition, a subdivision of Boynton Beach, Florida, as
recorded in Plat Book 1, Page 51~ Public Records of Palm Beach
County, Florida~ have petitioned the City CoUncil of the City of
Boynton Beach, Florida, for adoption of a resolution vacating and
abandoning a dedicated 20-foot right-of-way presently abutting
the east side of their said lots and lying between Blocks 1 and
2 of said Roberts Addition and running from N. E. 5th Avenue to
N. E. 6th Avenue in the City of Boynton Beach, Florida; and
WHEREAS, said request has heretofore been considered by the
Planning and Zoning Board of the City of Boynton Beach, Florida~
and a favorable recommendation has been rendered in connection
therewith; and
WHEREAS, all affected public utilities have been contacted
for their recommendations in connection with said request, and
their recommendations have been received; and
WP~REAS, the City of Boynton Beach deems it necessary to
reserve unto itself a utility easement as to said dedicated
20-foot right-Of-way; and
WHEREAS, said request for abandonment is deemed to be reason-
able and in the best interests of the inhabitants of the City
of Boynton Beach, Florida, subject to said utility easement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF BOYNTON BEACH,
FLORIDA:
Section 1: That the said dedicated 20-foot right-of-way
abutting the east side of Lots 2~ 3, 6, 7, 10 and 11, Block 2,
Roberts Addition, a subdivision in the City of Boynton Beach,
Florida, as recorded in Plat Book 1, Page 51, Public Records
of Palm Beach County, Florida, lying between Blocks 1 and 2
of said Roberts Addition, and running from N. E. 5th Avenue
to N. E. 6th Avenue in the City of Boynton Beach, Florida, is
hereby vacated and abandoned and is hereby returned to acreage
for purposes of taxation, subject, however~ to a utility ease-
ment as to said 20 feet, which easement is hereby expressly and
specifically established and reserved by the City of Boynton
Beach, Florida.
