73-YRESOLUTION NO. 73-Y
A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA~
VACATING AND ABANDONING CERTAIN UTILITY EASEMENTS
WHEREAS, the owner of the land as hereinafter described has
petitioned the City Council o£ the City of Boynton Beach, Florida, for
the adoption of a resolution vacating and abandoning certain utility
easements presently lying in and upon said lands; and
WHEREAS~ said petition has heretofore been considered by the
Planning and Zoning Board of the City of Boynton Beach, Florida, and
a favorable recommendation has been rendered in connection therewith;
and
WHEREAS, after thorough investigation and public hearing on said
application, it appears that no hardship will be occasioned by the
abandonment of said easements and that no present or future use of same
is contemplated, and that said abandonment will be for the best interest
of the general public~ and no valid reason exists why same should not
be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA:
Section 1: That the following described utility easements to wit:
That portion of Lot 22, DEWEY HEIGHTS Subdivision
of the City of Boynton Beach, Palm Beach County,
Florida~ according to the plat thereof on file in
the office of the Clerk of the Circuit Court in
and for Palm Beach County, Florida, in Plat Book
24, Page 193, particularly described as follows:
The East five feet as measured at right angles
and parallel to the East property line less N. 7.4
feet
AND
That portion of Lot 12, Block 4, SEACREST ESTATES
Subdivision of the City of Boynton Beach, Palm
Beach County, Florida~ according to the plat thereof
on file in the Office of the Clerk of the Circuit
Court in and for Palm Beach County~ Florida, in
Plat Book 24, Page 245~ particularly described as
follows:
The South 62 feet of the West 6 feet as measured
at right angles and parallel to the West property line,
are hereby vacated and abandoned~ and such areas are hereby returned
to acreage for purposes of taxation.
PASSED AND ADOPTED this 3rd day of April~ A. D. 1973.
