71-QRESOLUTION NO. 71 ~
WHEREAS, formal request has heretofore been made to the
City Council of the City of Boynton Beach, Florida, for abandonment of a
portion of certain plats, more particularly described hereinafter, including
dedicated rights-of-way and easements contained thereon, and
WHEREAS, subject matter has been considered by the Municipal
Planning and Zoning Board after due notice and public hearing, and
WHEREAS, affected utility companies have indicated that they
have no objection to granting of said request, and
WHEREAS, the granting of said request appears to be in the
best interest of the inhabitants of the City of Boynton Beach;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCII
OF THE CITY OF BOYNTON BEACH, FLORIDA:
1. That the following described portions of the plats of CONGR]
GROVE and ARDEN PARK, including all dedicated rights-of-way and public
utility easements contained therein, are hereby vacated and abandoned and
subject area is hereby returned to acreage for purposes of taxation:
(a) Lots 1 through 7, inclusive, Block 2; Lots 1 through 7,
inclusive, Block 3; Lots 1 through 7, inclusive, Block 4, CONGRESS GROVel,
recorded in Plat Book 13, Page 63, Palm Beach County Records.
(b) Lots 78, 79 and 81 through 89, inclusive, and Lots 114 thro
120, inclusive, ARDEN PARK, recorded in Plat Book 2, Page 96, Palm Beac[.
County Records.
Said composite tract containing 7.64 acres, more or less,
bounded on the West by N.E. 1st Street; on the South by N.E. 6th Avenue; on
the East by N.E. 3rd Street; the northerly boundary line being midway between
N. E. 8th Avenue and N.E. 7th Ave., within said East-West boundaries.
2. That the preliminary drawing and plat of a proposed sub-
division of the acreage tract describedhereinabove, now on file in the office
of the City Clerk, is hereby approved, pursuant to the ordinance of the City of
Boynton Beach in such cases made and provided.
