71-M RESOLUTION NO. 71-~ WHEREAS, the City Council of the CITY OF BOYNTON BEACH, FLORIDA, pursuant to the Charter of said City, deems it necessary for the public interest that the public streets of said City, more particularly described repaired, resurfaced and/or hereinafter, be improved by being built, rebuilt, and WHEREAS, the City Council of said City heretofore, by Resolution, according to law, required the City Engineer to prepare an estimated cost of such improvements and to prepare plans and specifications covering the construction of same, and WHEREAS, the said City Engineer has completed such requirements, and said plans and specifications are now on file in his office, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCI OF THE CITY OF BOYNTON BEACH, FLORIDA, as follows: 1. That the public streets hereinafter described shall be constructed and/or rebuilt over the public dedicated right-of-way thereof, in accordance with plans and specifications as required by the laws of the City of Boynton Beach, Florida, now on file in the office of the City Engineer, said streets being more particularly described as follows: A. That portion of S. E. 1st Avenue, lying between U. S. Highway No. 1 and S. E. 4th Street, consisting of approximately 300 lineal feet. Estimated No. Ft. That portion of N. W. 9th Avenue, lying between N. W. 5th Street and the southerly extension of east line of Lot 155 Cherry Hills, Plat Book 4, Page 58, consisting of approximately 400 lineal feet. The City Council will sit for the purpose of hearing if any, to the above proposed improvemen~on the 4th Gay of 1971, at the hour of 7:45 o'clock P. M. ~ at the Boynton Beach Cily Hall· Boynton Beach, Florida. 3. Each abutting property owner along the above proposed improvements shall be assessed on a front footage basis, charging said owner his proportionate share as divided by the total improvemenl cost. Any such assessment may be paid within ninety (90) days from the date of confirmation thereof, without interest. Thereafter, all assessments shall be payable in three (3) equal consecutive annual installments, together with interest at the rate of 8% per annum, from the expiration of the said ninety (90) days, in each of the succeeding years at the time or times in each year at which general municipal taxes are payable, provided that any assessment may be paid at any time before due, together with interest accrued thereon to the date of payment. 1971.
