A PROPOSED ORDINANCE O~~ TH~ TOWN OF BOYNTON, GRANTING A
PUBLIC FRA]~?CHISE.
BE IT ORDAINED BY THE TO~.~~, COMt.,'iISSION OF THE TOV~
OF BOTNTO~', FLORIDA:
Section 1. That permission be and the same is
hereby granted to the Southern Bell Telephone and
Telegraph Company, its successors and assigns,to erect,
operate and maintain lines of telephone and telegraph,
including the necessary poles, fixtures and electrical
conductors upon, along, under and over the public roads,
alleys, streets and highways of the Tov~n of Boynton,
Florida, as its business may from time to time require,
provided that all poles shall be neat and symmetrical.
Section 2. That the work of erecting poles by
virtue of this ordinan'ce shall be done under the sm per-
vision of the Town Commission, and the said Southern
Bell Telephone and Telegraph Company shall replace and
properly relay any sidewalk, street or curb that may
be displaced by reason of the erection of such poles,
an~ upon failure of the Company so to do, after twenty
(20) days' notice in writing shall have been given by
the Mayor of the said Town to said Company, the T~'~wn
may repair such portion of the sidewalk or street that
may have been disturbed by said Company, and collect
the cost so incurred from said Company.
Section 3. That in consideration of the rights
and privileges herein granted, said Company shall, upon
demand, provide space for one cross-arm on each pole,
on which said Town may desire to attach either fire
alarm, telegraph or police telegraph wires, for the
free use of the public and fire alarm telegraph system
of the said Town.
Section 4. That said Company shall at all times
be subject to the Town ordinances now in existence or
which may be hereafter passed relative to the use of
the public streets by telephone and telegraph companies.
Section 5. That said Company shall indemnify the
said Town against, and assume all liabilities for
damages which may arise or accrue to the said Tova
from any injury to persons or property from the doing
of any work herein authorized, or the neglect of said
Company or any of its employees to comply with any ordi-
nance relative to the use of the streets or said Toy,'n,
and the acceptance by the Company of this Ordinance
shall be an agreement by it to pay to .the said Tovm
any sum of money for which the Tov~n may become liable
for or by reason of such injury.
Section 6. That said Company shall file v~lth
the Town Clerk of the said Tov~ its acceptance of this
Ordinance within sixty (60) days from the date when
it shall take effect.
Section V. That this ordinance shall be in force
and effect for a term of thirty (30) years from and
after the date it shall take effect, and the said Town
hereby reserves the right and requires the said Company,
as a condition precedent to the taking effect of this
grant, to give and grant to the Town of Boynton, Florida,
the right, at and after vh~ e~piration of such term to
purchase the telephone ~nd telegraph lines or other pro-
perty in said Town used under or in connection with this
grant, or such part of such property as the minicipiaity
may desire to purchase at a valuation of the property,
real and personal, desired, which valuation shall be
fixed by arbitration, as m'~y be provided by law; and
the acceptance of this ordinance shall operate as a
grant by the said Oompany to the To~'~n of said right
to purchase.
Section 8. That this or~inance shall take effect,
and be in force from and after tarn (10) days after the
date of its passage.
