O#43ORDINANCE NO. 43. An Ordinance of the Town of Boynton, Florida, providing certain regulations for the use of traffic on the streets and public ways; prohibiting the use of certain Vehicles on such streets or oublic ways; fixing maximum weight of load, and / providing a penalty violation thereof. BE IT ORD~.~INED I~ T~-iE TOWN COI¥[MISSION OF THE TOI~ OF BOYNTON, FLORIDA: 1. It shall be unlawful to drive, propel, or operate, or cause to be driven, propelled, or operated, over any of the streeta' or public ways, within 'the Tov~n of Boynton, Florida, any vehicle or contrivance having whells provided with sharpened or roughened surface, other than rough pneu- matic rubber tires; provided, however, that this restriction shall not apply to vehicles or implements used by the state in the construction any maintenance of such roads, or any vehicles or implements used by the Tov~n in the construction and maintenance of any streets or public ways within said To~m, or to farm implements weighing less than one thousand pounds, and provided with wheel surface of more than one half inch in width. ?~aeels of traction engines or other vehicles, when provided with suitable filler blocks between cleats, shall be considered as having smooth tires. 2. It shall be unlawful to drive, propel or operate, or to cu~se to be driven, propelled or operated, over any of the streets or public ,~ys, within the Town of Boynton, Florida, any vehicle or contrivance whose gross load on any one wheel shall exceed six hundred pounds for each inch of width of tire on same; provided further that the width of solid tires shall be considered as that portion coming in contact with an unyielding surface, and the ,~vidth of pneu- matic tires shall be considered as the total thickness measured from outside to outside of casing, at the widest point~between tread and rim, when fully inflated with air; and provided further that any vehicle or contrivance whose gross load shall exceed sixteen thousand pounds shall be moved or operated over any of the streets or public ways within the Town of Boynton, Florida. 3. It shall be unlawful to allow any vehicle or contrivance, of any part of same, or an~ load or portion of a load carried on the same, to drag upon any of the streets or public ,~ys with the To¥~ of Boynton, Florida. 4. It shall be unalwful to place, or allow to be placed upon any of the streets or public ways within the Town of Boynton, Florida, any tacks, wire, scrap, metal, glass, crockery, or other substance, which may be in- jurious to the feet or persons, or animals, or the tires of vehicles, or in any way injurious to the road. 5. Any person, persons, firm or corporation, or ~y agent of such perscn, persons, firm or corporation, con- victed of a violation of this Ordinance, shall be subject to a fine of not less than ten (~lO.O0) dollars, or more than five hundred (~$$00.00) dollars or by imprisonment for not to exceed sixty (80) days, or both such fine and imprisonment, in the discretion of the court. 7. This Ordinance shall become a law immediately upon its passage. This Ordinance having been read in full at the reEular meeting of the Town Commissioners of the Town of Boynton, Flori.~a, held on the 5th day of August, _~. D. 1924, was duly adopted at a regular meeting held on the day of _, A. D. 1924. A copy was posted at the door of tile Town Ha Il, on the day of ~__,1924.
