O#39ORDINANCE NO. 39. An Ordinance of the Town of Boynton, Florida, providing for establishing a basis of settlement for lands acquired or taken from private individuals by said To~m for the purpose of opening, widening, grading, ~ving or otherwise establishing streets or sidewalks within said Town and providing for con- demnation of said lands as an alternative method of so acquir- ing or taking said lands. Be It Ordained by the To~ Commission of the Town of Boynton, Florida; 1. That whenever it shall be deemed necessary and ad- visable by the Town Commissioners of the Tovm of Boynton, Florida, to take or acquire private lands for the purpose of establishing, widening, altering, extending, grading, paving or otherwise establishing streets or sidewalks within said Town, said improvements so deemed necessary and advisable shall be set forth in a resolution duly adopted as provided by law. 2. That the cost of said public improvements shall be assessed against the property abutting on said street or im- provement in proportion to its frontage. 3. That said private property so taken by said Town for the purposes aforesaid shall be paid for by said Town on the following basis: Five Cents shall be allowed for each square foot of land taken by said Town, which amount shall be cre- dited on the amount assessed against said land in accordance with its frontage on said street or other improvement. 4. That in the event the said owner of the land affected by said improvement shall refuse to make settlemtn on the basis aforesaid, then the said Town Shall take said land by condemnation as provided by law. The above Ordinance having been read in full at a regular meeting of the Town Commission of the Totem of ~oynton, Florida, held on the 1st day of April ~. D. 1924, was adopted and approved at a regular meeting of said Commission held on the 15th day of April A. BE IT QRDAINED BY THE TO~ COL]~ISSiON OF THE TO~VN OF BOI~TON, FLORIDA: That Ordinance No. 39, be and the same is hereby amended to read as follows: 1. ~l~at whenever it shall be deemed necessary and advisable by the Town Co~missioners of the Town of Boynton, Florida, to take or acquire private lands for additional right-of-way for the purpose of widening, altering, or con- structing streets or sidewalks within said Town, said im- provements so deemed necessary shall be set forth in a reso- lution duly adopted as provided by ~. That the cost of said public improvement shall be assessed against the property abutting on said street or im- provement in proportion to its frontage. 3. That said private property so taken by said Town for the purposes aforesaid shall be paid for by the said Town on the following basis: five cents shall be allowed for each square foot of land taken by said Town for additional right-of-way, which amount shall be credited on the amount assessed against said land in accordance with the frontage on said street or sidewalk. ~.
