O#29 ORDINA~CE NO. 29 An Ordinance regulating the use of mufflers and cut-outs on motor vehicles in the Town of Boynton, Florida; regulating the quipment of my motor vehicle in said Town of Bo~rnton; regulating the use of lights on motor vehicles in the Town of Boynton; prescribing a penalty for the violation of this Ordinance and pro- riding for the Repeal of all Ordinances in conflict herewith; fixing the time when this Ordinance shall become effective. Be It Ordained by the Town Commiss~ on of the Town of Boynt on, Florida t Section 1. That the term "motor vehicle" as used in this Ordinance shall be held to include all motor vehicles, automobiles, motor trucks, motorcycles and all vehicles operated over public streets and highways of the Town and propelled by power other than muscular power. Section 9. It shall be unlawful for any person to operate, or stay owner to permit to be operated, any motor ve~icle or motorcycle on the streets of the Town, which said motor vehicle has not at said time a suitable muffler for proper and efficient work, and it shall fur- ther be unlawful for any person to operate, or for the owner of any motor vehicle to permit to be operated, any motor vehicle with the muffler cut-out or not in operation. Section ~. It shall be unlawful for any person or persons to operate any motor vehicle on the public highways of the To~,m of Bo~uaton unless said motor vehicle shall be provided at said time with adequate brakes, in good working order and sufficient to control such vehicle at all times when the same is in use, and said motor vehicle shall further be provided ¥~ith an adequate horn or other device for signalling, sufficient under all conditions to give timely warning of the approach of the motor vehicle, and said motor vehicle shall during the period, from one half hour after sunset to one half hour before sunrise, display at least two lighted lamps in front, and one on the rear of such vehicle; provided, that one light in the front and one in the rear of a motorcycle shall be sufficient. The lights of the front lamps shall be visible at least two hundred (~00) feet in the direction which the motor vehicle is proceeding, and shall be pro- vided with dimmers, or some other device equally suffi- cient, in protecting the driver of the vehicle travelling in the opposite direction. The person so operating said vehicle shall always use the dimmer's when said motor ve- hicle comes within two hundred (~00) feet of another ve- hicle travelling in the opposite direction, or where some other device is used, it shall be so arranged that the rays of the lights attached to said motor vehicles shall not shine more than four (~) feet from the ground at a distance of two hundred (~O0) feet ahead of said motor vehicle. Every person operating or driving a motor vehicle on the public highways of the Town shall also, when approaching any railroad crossing or a crossroad, or street or curb or corner in a hgihway or street, where the operator's view is obstructed, slow down the speed of tt~e same, and shall sound his horn or other device for signalling in such manner as to give notice and warning of its approach. Spotlights or lights commonly used and known as "spotlights" may be used on any motor vehicle in the Tovm; provided, that said spotlight shall have the rays of its light directed in front of and to the right of a center longitudinal line of said motor vehicle, and on the ground, not more than thirty (30) feet in front of said motor vehicle. Section 4. ~at any person, firm or corporation vio- lating any of the provisions of this Ordinance shall be punished upon conviction by f~.ne not exceeding ~100.00 or by imprisonment not exceeding ten days, or both, at the discretion of the court. Section 5. That this Ordinance shall take effect 16th day of June A. D. 1923. Section 6. That all Ordinances in conflict herewith be and the same are hereby repealed. The above Ordinance No. 29, having been read in full at a meeting of the Town Commission of ~e Tovm of Boynton, Florida, held on the 15th day of ~ay A. D. 19~3, was adopted and passed at a regular meeting of said Commission held on the Sth day of June A.
