On Street Improvement
An Ordinance providing for the grading, paving and
oiling a strip eight feet wide approximately parallel with
and commencing twelve feet from the track of siding of the
Railway and running North and South between Central Avenue
and what is known as Roberts crossing eight feet in width
and 325 feet in length which said paving is located within
the Town of Boynton and balance of preamble the same as in
Ordinance
V~hereas a petition under date of July ~2nd, 19~, has
been presented to the Town Commission for certain improve-
ments more particularly specified in the title of this Ordi-
nance which said petition was signed by Ed. ~eeks and E.Roberts.
BE IT ORDAINHD BY THE TO~¥N CO~ISSION OF TH7~ TOV~ OF
BOYNTON IN PAL~,[ BEACH COUNTY, FLORIDA, AS FOLLOWS: -
Sec. 1. That this Town Commission does hereby determine
and decide to open, establish, grade, fill in, clear, pave
and oil the streets of said Town of Boynton, Florida, more
particularly specified as follows: - a strip 6 to 8 feet wide
parallel with Railw?~y 325 feet in length between Central
Avenue and Roberts crossing; that this To%mn Commission fur-
ther decides and determines that it is immediately necessarY
to undertake and construct said improvements.
Sec. 2. That the said streets shall be graded, cleared,
paved, rocked and oiled, within the limits specified in the
· preceeding section of this Ordinance.
Sec. 3. That the paving is to be for the width of 8
feet approximately, measuring a distance of 3~5 feet appro-
ximately, adjoining the paving along the Railroad; that
the said streets are to be paved to a depth of eight inches
of rock; that they are to be scarified, rolled and then oiled.
Sec. 4. That the material to be used in the construc-
tion of said road shall be rock commonly known as Ojus rock,
as mined from quarries located in Dade County and Broward
County, Flori~.a; that the grade to be established is l~.~B
feet above the sea level all of said grades will more par-
ticularly appear in profiles on file in the office of the
Town Clerk of tke Town of Boynton, Florida. That the said
grades shall be according to grade stakes to be set on the
ground by the Town Engineer of the To~wn of Boynton; that
the area between the boundary lines of said paving shall
be thoroughly cleaned of all grass, trash, or other debris,
after which it shall be graded and paved with an average
depth of eight inches of Ojus rock; said streets shall then
have all inequalities removed, thoroughly rolled, watered,
graded and rerolled untill ready for surface treatment for
its entire width of 8 feet that one fourth gallon of bitu-
minous oil per square yard of surface shall be spread over
the said paving, said oil to be spread by hand or with a
machine of approved pattern; immediately after spreading,
the area so spread shall be matured and thoroughly covered
with clean sand all of the above work to be done according
to specifications and as shown on the place and profile
prepared by the To~n Engineer and now on file in the office
of the Town Clerk, all of which are made a part of this
Ordinance to the same extent as if fully set out herein.
Sec. 5. That the o~wner or owners of any lot or
parcel of land abutting on said streets wit~,in said
li~its are hereby ordered, directed and required to con-
struct, pave, improve and oil said streets, within ten
days from ~doption of this Ordinan~e; said improvements
to commence within said time to be completed not later
than sixty days from the adoption of this Ordinance.
Sec. 6. That if the owner or owners of any lot
or parcel of land abutting on said streets within said
limits shall fail or refuse to commence the said im-
provements within the time described herein, to-wit,
ten days from the adoption of this Ordinance, the Town
Commission of the Town of Boynton, shall cause the said
work to be done by contract or otherwise, as said
Commission may in its discretion, enter into separate
contracts for any grading, filling, clearing or paving,
or for any portion of either; the said commission may
in its discretion perform all or any portion of any
public work under its own supervision, under a foreman
or through agency, employing such labor as may be
necessary and not let the same under contract as may
in its opinion best serve the interests of the public.
~nen such work has been completed, the said Commission
may pay the expense of same out of any funds belonging
to the Town, or it may pay for the same with certifi-
cates of indebtedness. The Commission may assess the
expense of such work on the abutting property in propor-
tion to the frontage, which said assessment shall be
by resolution adopted after the completion of said im-
provements.
Sec.. 7. That this Ordinance ahall take effect
immediately upon becoming a law.
The above Ordinance No. 25 having been read in
full at a meeting of the Town Commission of the Town
of Boynton, Florida, held on the 26th day of July A. D.
192~, was adopted and passed at a special meeting of
said Commission held on the 26th day of July A. D. 1922,
and a copy thereof posted at the front door of the Town
Hall at Boynton, Florida, on the ~Tth day of July A.D.1922.
