On Street Improvement - Central Avenue
An Ordinance providing for the opening, establish.ing,
grading, paving and oiling of Central Avenue, a Street in
the ~ieeks and Andrews Addition to the Town of Boynton,
Florida, from the Railroad of the Florida East Coast Railway
Company westward to a point where a continuation of Green
Street intersects said Central Avenue, thence south from
said intersection on Green Street, a distance of approxi-
mately 330 feet more or less to the Present Paving on said
Green Street, which said Streets are located within the
Town of Boynton, Florida; stating in a general way the
work to be done, the Limits within which said work is to
be done, the materials to be used, the grade to be estab-
lished, the fill to be made and the width of said paving;
determining and deciding on the necessity of said improve-
ments; directing and requiring the owner or owners of any
Lot or Parcel of Land abutting thereon to improve said
Streets; fixing the time within which said owner or owners
shall commence the Improvements of said Street and pre-
scribing that if said owner or owners shall refuse to
comply with the provisions of this Ordinance within the
time specified herein, the Town Commission of the Town of
Boynton, Florida, shall cause the said work to be done
by contract or otherwise and assess the expense of such
work on the abutting property in proportion to the frontage;
authorizing the fixing of said assessment when the said
improvements are completed.

provements more particularly specified in the title of
this 0~dinance, which said petition was signed by Ed.

AS FOLLOWS:
Sec. 1. That this To%,wn Commission does hereby de-
termine and decide to open, establish, grade, fill in,
clear, pave and oil the streets of said Town of Boynton,
Florida, more particularly specified as follows: Central
Avenue according to the plat of the Neeks and Andrews
Addition to the Town of Boynton, Florida, from the rail-
road of the Florida East Coast Railway Company 'Jestward
to a point where the continuation of Green Street inter-
sects said Central Avenue; thence South on said Green
Street, a distance of approximately 330 feet, more or
less, to the paving as at present located on said Green
Street; that this Town Commission further decides and
determines that it is immediately necessary to undertake
and construct said improvements.
Sec. 2. That the said streets shall be graded, cleared,
paved, rocked and oiled, within the limits specified in the
preceding section of this Ordinance.
Sec. 3. That the paving is to be for the width of
l0 feet, measuring a distance of 2302 feet on each side of
the center of the right-of-way of said streets; that the
said streets are to be paved to a depth of eight inches
of rock; that they ~re to be scarified, rolled and then
oiled.
Sec. 4. That the material to be used in the construc-
tion of said road shall be rock commonly known as 0jus rock,
as mined from quarries located in Dade County and Broward
County, Florida; that the grade to be established is 12.~2
feet above the sea level at the East end of Central Avenme
and 18.2~ feet above sea level at the ~est end of said
Central Avenue, ~d gradually sloping each way from the
said Western end of Central Avenue, which said point is
the intersection between the continuation of Green Street
and said Central Avenue; all of said grades will more
particularly appear in profiles on file in the office
of the Town Clerk of the Town of Boynton, Florida; that
the fill to be made is apProximately fourteen inches, in
two separate locations on said street, each location
being for t~ approximate length of 100 feet; that said
grades shall be according to grade stakes to be set on~
the ground by the Town Engineer of the Town of Boynton;
that the area between the boundary lines of said paving
shall be t~oroughly cleaned of all grass, trash or other
debris, after which it shall be graded and paved with
an average depth of eigh~ inches of 0jus rock; said
streets shall then have all inequalities removed, tho-
roughly rolled, watered, graded and rerolled until ready
for surface treatment for its entire width of l0 feet;
that one fourth gallon of bituminous oil per square yard
of surface shall be spread over the said paving, said
oil to be spread by hand or with a machine of approved
pattern; immediately after spreading, the area so spread
shall be matured and thoroughly covered with clean sand,
all of the above work to be done according to specifica_
tions and as shown on the place and profile prepared by
the Tov~ Engineer and now on file in the office of the
Town Clerk, all of which are made a part of this Ordi-
nance to the same .extent as if fully set out herein.
Sec. 8. That the owner or OWners of any lot or
parcel of land abutti~g on said streets within said
limits are hereby ordered, directed and required to
construct, pave, improve and oil said streets, within
ten days from the adoption of this Ordinance; said im-
provements to be commencerS, within said time and to be
completed not later than sixty days from the adoption
of this Ordinance.
Sec. 6. That if the owner or OWners of any lot or
parcel of land abutting on said streets Within said
limits shall fail or refuse to core,hence the said im-
provements within the time described herein, to-wit,
ten days from the adoption of this Ordinance, the Town
Commission of the Town of Boynton, Florida, shall Cause
the said work to be done by contract or othezw~ise, as
said Commission may in its descretion ente~ into separate
contracts for any grading, filling clearing or paving,
or for any portion of either; the said Commission may
in its discretion Perform all or any portion of any
public work under its own supervision, under a foreman
or through agency, employing such labor as may be necessary
and not let the same under contract as may in its opinion
best serve the interests of the public. ~hen such work has
been completed the said Commission may pay the expense of same
out of any funds belonging to the To~wn, or it may pay for the
same with certificates of indebtedness. The Commission may
assess the expense of suc)~ work on the abutting property in pro-
portion to the frontage, which said assessment shall be by
resolution adopted after t~e completion of said improvements.
Sec. 7. That this Ordinance shall take effect imme-
diately upon its becoming a law.
The above Ordinance No. ~, having been read in full at
a meeting of the To~ Commission of the Town of Boynton, Flo-
rida, held on the 8th day of July A. D. 19~, was adopted
and passed at a Regular ~eeting of said Commission held on
the 18th day of July A. D. 192~, and a copy thereof posted
at the front door of the Town Hall at Boynton, Florida, on
the l~th day of July A. D. 1922.
