O#23 ORDINANCE NO. 2~. Electical Ordinance. An Ordinance establishing an Electical Department for the Town of Boynton, Florida, and providing for the Regulation and Inspection of certain Electrical installa- tions and for other purposes. Be It Ordained by the Town Commission of the To~ of Boynton, Florida: Section 1. That any and all electrical wiring, switchboard apparatus or appliances installed or connected in the Town limits of Boynton, Florida, ~hall be installed and connected in conformity with the latest edition of the regulations of the National Board of Fire Underwriters of Electrical wiring and apparatus commonly and hereinafter for the purpose of this Ordinance known and described as the "National Electrical Code", a copy of the same being filed with the Town Clerk and marked for indentification by t he signature of the I~ayor and Town Clerk, ~ud which latest edition is hereby made a part of this Ordinance, and that all wiring devices.and material used in such installation or connections shall be such as have been inspected and listed as approved by the Underwriters Laboratories of the National Board of Fire Underwriters. Section ~. That the position of Electrical Inspector is hereby established. The Electrical Inspector shall be a competent man appointed by the Town Commission. He shall receive such compensation as the T~vn Commission may fix by resolution. It shall be the duty of the Electrical Inspector to issue permits as hereinafter provided for the installation, extension, alteration or rearrangement of all electrical wiring and service connections for light, pov~r and other purposes, and to see that all such wiring and all electrical appliances and devices are installed and maintained in accor- dance with the latest edition of the National Electrical Code, and that all materials and wiring devices used are such as have been approved and listed by the Underwriters Laboratories, a copy of which is filed herewith and marked for indentification by the signature of the Mayor and the Town Clerk, and the same is hereby made a part of this Ordinance. The Electrical Inspector is hereby authorized, em- powered and directed to enter any building, store, resi- dence or enclosure at all reasonable hours to inspect the installation or condition of electrical wiring or the appliances connected thereto. ?~ilful hindrance of, or refusal to permit~entrance of the Electrical Inspector during reasonable hours, or interference with him in the performance of his duties shall be deemed to be a violation to this Ordinance. Section 3. The Electrical Inspector shall issue permits to install, remodel or enlarge electrical wiring and appli- ances and such permits shall be obtained for each new installa- tion or extensive alteration before such ¥~ork begins. At the time such permit is requested the Electrical Inspector may demand plans showing the number and arrangement of circuits or outlets and the size of conduits and con- ductors, and the nu~nber and type of the appliances to be connected and the r~ame or names of the manufacturers of the material and devices to be used. In all cases it shall be definitely shown that the material and de- vices to be used are approved by the Underwriters Lab- oratories and the burden of making such proof shall rest on the licensee making application for permit. Section 4. That it shall be the duty of the Electri- cal Inspector or his authorized assistant, to make inspec- tion within 24 hours, when requested by auy licensee and to avoid, as far as possible, causing delay or inconvenience to building operations. All new work to be concealed shall be inspected before being lathed, plastered, floored or covered over or otherwise rendered inacessible for inspec- tion; all finished work, alteration work or the wiring of finished buildings shall Oe so installed that the inspec- tortor can satisfy himself that the requirements of the National Electrical Code have been complied v~ith and this provision is and sha~.l be construed to mean that, whereever possible and practicable, when wiring pockets have been cut or floor or siding removed or partially removed to permit the installation of wiring or wiring devices the said openings shall not be closed until opportunity has been given the inspector to examine the wiring installed. Section 8. That on the completion of any new in- stallation or extensive alteration a final inspection shall be made before a Service Permit is issued. It shall be unlawful for any Power Company, Public Service Corporation or other person, firm, tr~st or asso- ciation engaging in the furnishging, sale or delivery of electrical power to connect from any of their mains, cir- cuits or other wires if conductors to the light or wiring on any store, dwelling, building or enclosure or any other wiring system other than their own or to furnish any elec- trical power to such system unless authorized in a Service Permit issued by the Electrical Inspector. It shall be unlawful for any person, firm or corpora- tion to use any electrical current in or through any wiring apparatus or fixtures for light, heat or power in or on any building or structure within the limits of the To'~m of Boynton until the sa~e shall have been inspected and approved by the Electrical Inspector, and the certificate hereinafter provided for shall have been issued therefor. The Electrical Inspector is authorized to issue temporary Service Permits when he can satisfy himself that an emergency exists or that it will not endanger life or property. Tem- porary permits shall not continue in force for a period of more than three months. Nothing in this Ordinance shall be construed as re- quiring the issue of a new service permit where a vendor makes seasonal delivery of current to any premises and dis- continues said service during portions of the year unless such service has been discontinued by order of the Electri- cal Inspector as hereinafter provided. Section 6. That each wiring permit and each service permit shall bear a serial number, the permit to be de- tachable from a similarly numbered bound stub ~hich shall be filled in by the Electrical Inspector or his authorized assistant listing the date of the issue, and the name of person, firm, corporation, trust or person to whom issued. The Electrical Inspector shall be responsible for each and every blank pa~rmit lost, torn or destroyed or otherwise re- moved from any book in his oossession or in the possession of any of his assistants. The wiring and Service Permit books shall be audited monthly by the Town Clerk. Section V. That whenever and wherever in the judg- ment of the Electrical Inspector any electrical wires or appliances connected thereto shall become defective and dangerous either through the insufficient insulation, im- proper location or installation or any other cause whereby the same may become a menace to life or property, the said inspector shall cause the removal or correction of such de- fect by at once giving notice in writing, or verbally con- firmed by writing to the owner or user of such defective wiring or device or appliance specifying a limit of not more than ten days during which time the said defect and danger shall be removed, in event of failure on the part of the owner or user to comply within the specified time with such notice the Electrical Inspector shall order the elec- trical service to the premises immediately disconnected and discontinued and it s~all be unlawful for any person to re- connect such service until the defect shall have been cot- rected and a Service ?er~nit issued. Section 8. That Electrical Inspector or any other competent person delegated by him shall have power to re- move or authorize the removal of any wires or the turning off of any current on any circuits where such wires or current may interfere with the work of the Fire Department or endanger the lives or property of persons in proximity to a burning building, shed, house or other st~uctu~e. If upon inspection where taped joints are found un- soldered, the inspector shall require all joints untaped and left untaped until an inspection of all Joints have been made. All plumbing and other piping, tubing or metal work in any building shall be in place on concealed work before the electric wiring is reported for inspec- tion. No wiring will be considered as complete until such piping is in place. Section 9~ That all electrical wiring installed in any building within the inner fire limits and to be used for carrying power or lighting currents shall be installed in metallic conduit and in accordance with the National Electrical Code governing conduit work. Rigid metallic conduit shall be used on all concealed work where it is practicable to install same where the installation of rigid conduit is impracticable, the Electrical Inspector shall give pezm~ission for the use of flexible metallic conduit and said permission shall state the reason rigid conduit cannot be used. The Electrical Inspector shall keep a file copy of all such permissions issued and this file be open to public inspection at all reasonable hours. (This Section 9 held for l~rther consideration) Section 10. That all ordinances and parts of Ordi- nances in ccnflict with this Ordinance are hereby repealed. Section ll. That any person violating any of the pro- visions of this Ordinance shall be punished by fines not ex- ceeding One Hundred Dollars ($100.00) or imprisonment in the Town Jail or at hard labor on the streets or other public works of said To~n for a period not exceeding sixty days or by both such fine and imprisonment. Section l~. This Ordinance shall take effect imme- diately upon its passage, or as soon thereafter as it can become effective under the Town Charter. The above Ordinance No. 23, having been read in full at a meeting of the Town Commission of the To~wn of Boynton, Florida, held on the 16th day of ~iay A. D. 19~, was adopted and passed at a regular meeting of said Commission held on the 16th day of ~ay A.
