70-GGRESOLUTION NO. 70-GG
WHEREAS, the owner of all of the lands abutting a certain ten
foot publicly dedicated utility easement lying between Lot 4 and Lot 5,
Block 45, Section 5A, PALM BEACH LEISUREVILLE, Plat Book 29, Page 36,
public records Palm Beach County, has petitioned the City Council of
the City of Boynton Beach, Florida, for the adoption of a Resolution
vacating and abandoning said publicly dedicated utility easement; and
WHEREAS, it appears that subject easement has never been used
by the general public or any franchised public utility; and
WHEREAS, after thorough investigation and public hearing on said
application, it appears that no hardship will be occasioned by the
abandonment of said easement and that no present or future use of same
is contemplated, and that said abandonment will be for the best interest
of the general public, and no valid reason exists why same should not
be vacated;
NOW, THEREFORE, BE IT RE~OLVED BY THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA:
That the ten foot public utility easement lying between Lot 4
and Lot 5, Block 45, Section 5A, Palm Beach Leisureville~ Plat Book 29,
Page 36, public records Palm Beach County, is hereby vacated and
abandoned and is hereby returned to acreage for purposes of taxation.
