AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, BY
AMENDING ORDINANCE NO. 91-70 OF THE
CITY OF BOYNTON BEACH, REZONING THE
SEACREST SCRUB FROM SINGLE FAMILY
RESIDENTIAL AND DUPLEX RESIDENTIAL TO
RECREATION; PROVIDING FOR CONFLICTS,
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach, Florida has
adopted Ordinance No. 91-70, in which a Revised Zoning Map was adopted for said
City; and
WHEREAS, in 1993, the City of Boynton Beach and Palm Beach County
entered into an interlocal agreement for the acquisition and management of the
Seacrest Scrub Ecosite; and
WHEREAS, the pursuant to that Agreement, the City was required to amend
the land use and zoning to designate the property for use as a "conservation" area;
and
WHEREAS, the land use for this parcel was a part of the EAR-based
Comprehensive Plan amendments and was adopted by Ordinance No. 00-27, adopted
on June 20, 2000; and
WHEREAS, pursuant to Section 9 of Appendix A-Zoning, of the Code of
Ordinances, City of Boynton Beach, Florida, the rezoning of this tract of land, more
>articularly described hereinafter, from Single-Family Residential (R-1AA) and
2)uplex Residential (R-2) to Recreation (REC) completes the required process; and
WHEREAS, the City Commission deems it in the best interests of the
inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter
set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The following described land, located in the City of Boynton
Beach, Florida as set forth as follows:
See Attached Exhibit "A"
,e and the same is, hereby rezoned from Single-Family Residential and Duplex
to Recreation. A location map is attached hereto as Exhibit "B" and made a
)art of this Ordinance by reference.
Section 2: That the aforesaid Revised Zoning Map of the City shall be amended

Section 3: All ordinances or parts of ordinances in conflict herewith are hereby
)ealed.
Section 4: Should any section or provision of this Ordinance or any portion
,= declared by a court of competent jurisdiction to be invalid, such decision shall
affect the remainder of this Ordinance.
Section 5: This ordinance shall become effective immediately upon passage.

+That part of the Southwest quarter of Government Lot 2 lying West of the Florida East
Coast Railway right-of-way, together with the South half of Government Lot 3, the
Southeast quarter of Government Lot 4, that part of the North quarter of the Southwest
quarter of the Northeast quarter of Section 4, lying west of the Florida East Coast
Railway right-of-way; and the North quarter of the Southeast quarter of the Northwest
quarter of Section 4, all lying in Section 4, Township 46 South, Range 43 East, Palm
