R66-LLRESOLUTION NO. 66-LL WHEREAS, the owners of all lands abutting that portion of S.E. 1st Avenue (Jessamine Street), lying between U.S. Highway No. 1 and S.E. 4th Street, within the City of Boynton Beach, Florida, have heretofore requested the City Council of said Municipality to adopt a resolution abandoning and vacating said portion of dedicated roadway; and, WHEREAS, said portion of dedicated roadway has never been opened up, improved or otherwise utilized by the general public; and, WHEREAS, the basis of said request is to enable the owners of the abutting lands to fully develop and improve subject area of the City by the construction of permanent commercial physical improvements thereon which will not only benefit the general public from an aesthetic standpoint but will also add greatly to the value of taxable improved property within the City; and, WHEREAS, after public hearings before the Municipal Planning Board and the City Council, no valid reason has been brought forth as to why said request should not be granted; and, WHEREAS, the granting of said request is deemed to be in the best interest of the general public and the inhabitants of the City of Boynton Beach, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: 1. THAT, that portion of S.E. 1st Avenue (Jessamine Street), lying be.!'ween U.S. Highway No. 1 and S.E. 4th Street is hereby vacated and abandoned and subject area is hereby returned to acreage for purposes of taxation; 2. THAT, the granting of the above application is further deemed to be contingent upon the development and improvement of subject property within ~4 months after the effective date of this Resolution in full accordance with the tentative plans therefore now on file in the office of the City Manager of the City of Boynton Beach, and unless actual construction of subject property has been commenced within said _~-month period, this resolulion shall be declared automatically recinded, null and void, and of no legal effect. 3. It is further declared that this Resolution shall not become effec- tive until and unless the purchase of all the property abutting the above described dedicated roadway shall have been closed and completed by the proposed developer, Robert Rappaporl and Associates.
