R66-GG RESOLUTION NO. 66-GG WHEREAS, recent damage or defects occurring in certain portions of the municipal sewer system located in the ROLLING GREEN RIDGE area ha necessitaled immediate and extensive repairs to said segment of subject sewer system; and, WHEREAS, the cost of subject repairs, based upon competitive bids amounts to $29, 146.00, which figure is in excess of ten percent (10%) of the amount of the annual municipal budget for the operation and maintenance of the municipal water and sewer systems for the current fiscal year; and, WHEREAS, pursuant to the provisions of Resolution No. 64-FF, to the expenditure of such funds, it is necessary that the City Manager submit a written finding and recommendation to the City Council justifying such ex iture, and that certification be furnished by the City's Consulting Engineers that such expenditures are necessary for the continued operation of the water and sewer systems; and, WHEREAS, such written report and certification have heretofore been furnished to the City Council establishing the fact that said repairs are vitally necessary for the continued operation of the sewer system in subject area; that copies of said report and certification are attached hereto and made a part hereof; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THE CITY OF BOYNTON BEACH, FLORIDA. THAT the findings and recommendations of the City Manager and the City's Consulting Engineers, with regard to the repairs to portions of the municipal sewer system located in the ROLLING GREEN RIDGE area, are her~ by approved and the Mayor and the City Clerk are hereby authorized to execute the construction contract with Inter-County Construction Company, the low bidder for subject project, in the amount of $29,146.00. Under a provision of the 1964 Bond Ordinance, it is necessary for the City of Boynton Beach to have a cer- tificate of necessity from your consulting engineers, in order to increase expenditures from the'Sewer operation and Mainte- nance Budget in excess of 10%. 2. The sewer system in Rolling Green Ridge is in need of immediate and extensive repairs. Competitive bids received on June 6, 1966 revealed a Iow bid of $29',146~ This figure is in excess of 10% of thiS fiscal year's operation and maintenance budget~ 5. Accordingly, this letter constitutes your formal determination by your consulting engineers that expenditure of the contract sum is vitally necessary for the Continued opera- tion of the sewer system in the Rolling Green Ridge area. Portions of the'System are now inoperative, and a temporary bypass is handling the sewage at prohibitive expense. Kain City Manager Certificate for Repair Sanitary Sewer Lines By the terms of the 1964 bond issue, specifically Resolu- tion 64-FF, expenditures in excess of 10 pe~ cent of the amount of any annual budget which are needed for repair, maintenance and for the continued operation of the water and sewer system must have prior recommendation by the consulting engineers and must also be recommended by the city manager. This stipulation is contained in Section I of the resolution, page 30. In accordance with the terms of the resolution we have received a letter of certificate dated June 13, 1966. This letter reviews the low bid for the repair of the Rolling Green Ridge system in the amount of $29,146. The letter states that a formal determination by the consulting engineers is that the expenditure of this sum is vitally necessary for the complete and continued operation of the sanitary sewer system in the Rolling Green Ridge area. As you know, the bid referred to in this letter was a result of a competitive bid process in which two qualified!firms submitted proposals to do this work. The bid was submitted according to law and was duly accepted by the City Council. The total operating expenses as budgeted for the water and sewer system.for the fiscal year 1965-66 is $243,109o Con- tract bid price, of course, exceeds this amount by more than 10 per cent. In accordance with the terms of the referenced resolution, I hereby certify to the Council that the expendi- ture is necessary for the operation and maintenance of the water and sewer system. This finding is based on our research and review of the facts relating to the damage to and the inoperative condition of the Rolling Green Ridge water and sewer system. FTK: jp
