RESOLUTION NO. 66- Q WHEREAS, the City Council of the CITY OF BOYNTON BEACH, FLORIDA did, on February 7, 1966 enact Resolution No. 66-E wherein and whereby the conveyance of a certain 20-acre parcel of land to the Board of Public Instruction of Palm Beach County, Florida, described as: A parcel of land in Section 5, Township 46 South, Range 43 East, more particularly de- scribed as follows: From the NW corner of Government Lot 3 of said Section 5, run South 0© 20' 43"East, along the West line of said Government Lot 3 for 933.40 feet; thence run North 87© 18' 34" East for 934.41 feet; thence run North 0© 20' 43" West for 933.40 feet to a point on the North line of said Government Lot 3; thence run South 87© 18' 34" West, along said North line fo~ 934.41 feet to Point of Beginning, containing 20 acres, more or less; was authorized for the purpose of the construction of a vocational school facility thereon; and, WHEREAS, the consideration for such action was the understanding and belief on the part of the said City Council that said facility would be con- structed upon subject parcel on a first priority and immediate basis; and, WHEREAS, as part of the above offer, the said City Council has allocated and withheld certain funds constituting a portion of its 1964 Water and Sewer Revenue Bond Issue Construction Fund for the purpose of affording and bringing utilities to said site, all at the cost of the City; and, WHEREAS, the City has been advised by the Board of Public Instruc- tion of Palm Beach County that it does not intend to utilize subject proffered site for the immediate construction of a vocational school facility and that the first of said facilities shall be constructed in the Northern section of Palm Beach County, and further that no definite commitment can be given at this time as to the date on which a vocational school facility will be constructed on the site in question; and, WHEREAS, a continuation of the public controversy which has arisen as a result of the above action of the Board of Public Instruction of Palm Beach County, Florida, is deemed contrary to the general public good and welfare; and WHEREAS, it is legally impossible for the City Council to further withhold the investment of the above funds in revenue producing facilities; NOW, THEREFORE, be it resolved by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: THAT based upon all of the above, Resolution No. 66-E of the CITY OF BOYNTON BEACH, FLORIDA, and the provisions thereof, including the deed of conveyance executed pursuant thereto, are hereby rescinded, revoked, 'and declared null and void. BE IT FURTHER RESOLVED that the CITY OF BOYNTON BEACH, FLORIDA expresses its continued willingness to cooperate with the Board of Public Instruction of Palm Beach County on all matters pertaining to the furtherance and betterment of education in Palm Beach County in general, and the South Palm Beach County area, in particular, and further declares that in the event the property previously tendered to the School Board has not been utilized by the City for other municipal purposes, prior to the establishment of an immediate need therefore by the School Board, that same shall be made available for vocational school purposes.
