R66-DRESOLUTION NO. 66- [~ WHEREAS, the owners of lands abutting certain thirty foot dedicated rights-of-way lying within the City limits of the City of Boynton Beach, Florida more particularly described hereinafter, have heretofore petitioned the City Council of the City of Boynton Beach, Florida, for the adoption of a resolution vacating and abandoning subject rights-of-way; and WHEREAS, it appears that subject roadways have never been laid out, improved or used by the general public; and WHEREAS, after thorough investigation, including a public hearing before the ~nu~l~icipal planning board, which has favorably recommended su~ abandonment, there appears to be no valid reason why subject roadways should not be vacated and abandoned; and WHEREAS, in consideration of subject abandonment, the owners of the abutting properly have agreed to dedicate certain needed rights-of-way for the installation and construction of Congress Avenue, NOW THEREFORE, be it resolved by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: That the following described unimproved dedicated road rights-of-way lying within the subdivision of Sections 29 and 20, Township 45 South, Range 4~ East, according to the plat thereof on file in the office of the Clerk of the Cir- cuit Court in and for Palm Beach County, Florida, recorded in Plat Book 7, page 20, are hereby vacated, nullified, closed and abandoned and subject area~ are hereby returned to acreage for purposes of taxation: (a) Thirty (30) foot road right-of-way lying along the north side of Lot 93 and thirty foot road right-of-way lying along the north side of Lot 86 of said subdivision; (b) Thirty (30) foot road right-of-way lying adjacent to and between Lot 79 and Lots 82 through 93 inclusive on the West, and Parcel "C" and Lots 68 through 78 inclusive on the East, running north- ward from the north right-of-way line of Old Boynton Road West, to the South right-of-way line of the Boynton Canal; (c) Thirty (30) foot road right-of-way lying North of the North right-of-way of the Boy-nton Canal and South of Lot 94 of said Subdivision. That the purpose of this Resolution is to ratify and confirm previous action of the City Council of the City of Boynton Beach, Florida, vacating the above-described road rights-of-way as more particularly set forth in Resolutions65-0, 65-P and 65-GG of said City.
