AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING THE TEXT OF THE SUPPORT
DOCUMENTS OF THE FUTURE LAND USE ELEMENT
OF THE COMPREHENSIVE PLAN IN CONNECTION
WITH APPLICATION NO. 21, PLANNING AREA
1.H; SAID TEXT AMENDMENT WILL ALLOW A
LOCAL RETAIL COMMERCIAL AND A LOW
DENSITY RESIDENTIAL LAND USE
DESIGNATION; PROVIDING A CONFLICTS
CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY FOR CODIFICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHerEAS, the City Commission of the City of Boynton Beach,
Florida has adopted a Comprehensive Plan and as part of said Plan
a Future Land Use Element by Ordinance 89-38 in accordance wit~
the Local Government Comprehensive Planning Act; and
WHEREAS, Christopher Cutro, agent for the City of Boynton
Beach, Florida has applied to amend a portion of the Support
Documents of the Future Land Use Element entitled Land Use
Problems and Opportunities, Planning Area No. 1, Area 1.h.; and
WHEREAS, the procedure for amendment of the Comprehensiv~
Plan as set forth in Chapter 163, Florida Statutes, has beer
followed; and
WHEKEAS, after public hearing and study, the City Commissior
deems it in the best interest of the inhabitants of said City t~
amend the text of the aforesaid Support Documents of the Futur~
Land Use Element of the Comprehensive Plan as adopted by the Ci~
herein.
NOW, THEREFORE, BE IT ORDAINED BY T~-~ CITY CO~4ISSION OF T~
CITY OF BOYNTON BEACH, FLORIDA, T~_AT:
Section 1: The portion of the Support Documents of th~

Section 2: That all ordinances or parts of ordinances ir
conflict herewith be and the same are hereby repealed.
Section 3: Should any section or provision of thif
ordinance or portion hereof, any paragraph, sentence, or work bi
declared by a court o~ competent jurisdiction to be invalid, suct
decision shall not affect the remainder of this Ordinance.
Section 4: Authority is hereby granted to codify sai(
ordinance.
