AN ORDINANCE OF THE CI~T COMMISSION OF
THE CITY OF BOYTON BEACH, FLORIDA,
REGARDING APPLICATION NO. 21, PLANNING
AREA 1.h (LOTS ON THE EAST SIDE OF U.S.
1 , LYING BETWEEN BERNARD ' S
(BENVENUT0 ' S) RESTAURANT AND YACHTMAN' S
COVE) AMENDING ORDINANCE 89-38 OF SAID
CITY BY AMENDING THE LAND~ USE ELEMENT OF
THE COMPREHENSIVE PLAN OF THE CITY BY
ADOPTING THE PROPER LAND USE OF CERTAIN
PROPERTY, MORE PARTICULARLY DESCRIBED
HEREINAFTER; SAID LAND DESIGNATION IS
BEING CHANGED FROM HIGH DENSITY
RESIDENTIAL TO LOW DENSITY RESIDENTIAL;
PROVIDING A SAVINGS CLAUSE; PROVIDING
REPEALING PROVISIONS; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach
Florida has adopted a Comprehensive Land Use Plan and as part o~
said Plan a Land Use Element by Ordinance No. 89-38 in accordanc~
with the Local Government Comprehensive Planning Act; and
WHEREAS, the City Con,mission
Florida adopted as part of said Plan a
Documents of the Future Land Use Element
Land Use Problems and Opportunities; and
WHEREAS, the City Commission of the

Florida elected not to emend the City's Official Zoning Ma~
pursuant to recommendations within said Section VIII. (Planninc
Area 1, Area 1.h); and
WHEREAS, Christopher Cutro, agent for the City of Bo!rnto
Beach Florida, has heretofore requested the above mentioned Lan(
Use Element Amendment; and
W~RREAS, the procedure for amendment of a Land Use Element
of a Comprehensive Plan as set forth in Chapter 163, Florid~
Statutes, has been followed; and
W~EAS, after public hearing and study, the City Commissior
deems it in the best interest of the ~h~h~ ~ ~=~ ~
That the Land Use of the following described
Low Density Residential. Said land is more
described as follows:

92, lying East of U.S. 1 right-of-way,
less the West 253.59 feet thereof.
Containing 3.77 acres, more or less, and
subject to easements and rights-of-way
records.
Section 2: That any maps adopted in accordance with
the Land Use Element of said Comprehensive Plan shall be
amended accordingly.
Section 3: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 5: This Ordinance shall become effective
immediately upon its final passage.
