O92-29ORDINANCE NO. 092- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING APPLICATION NO. 21, PLANNING AREA 1.h (LOTS ON THE EAST SIDE OF U.S. it LYING BETWEEN BERNARD'S (BENVENUTO'S) RESTAURANT AND YACHTMAN'S COVE) AMENDING ORDINANCE 89-38 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY ADOPTING THE PROPER LAND USE OF CERTAIN PROPERTY, MORE PARTICULARLy DESCRIBED HEREINAFTER; SAID LAND DESIGNATION IS BEING CHANGED FROM HIGH DENSITY RESIDENTIAL TO LOCAL RETAIL COMMERCIAL; PROVIDING A SAVINGS CLAUSE; PROVIDING REPEALING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted a Comprehensive Land Use Plan and as part of said Plan a Land Use Element by Ordinance No. 89-38 in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the City CommLtssion of the City of Boynton Beach Florida adopted as part of said Plan a portion of the Support Documents of the Future Land Use Element entitled Section VIII. Land Use Problems and Opportunities; and W~RREAS, the City Commission of the City of Boynton Beach, Florida elected not to amend the City's Official Zoning pursuant to recoA~uendations within said Section VIII. (Planr~n~ Area 1, Area 1.h); and WH~EAS, Christopher Cutro, agent for the City of Boyntor Beach Florida, has heretofore requested the above mentioned Lan~ Use Element Amendment; and ~IEREAS, the procedure for amendment of a Land Use Elemez of a Comprehensive Plan as set forth in Chapter 163, Florid~ Statutes, has been followed; and WP~EREAS, after public hearing and study, the City Co~'~a~issiot deems it in the best interest of th~ ~nh~h~ ~ ~=~ ~.. ~ That the Land Use of Local Retail Commercial. described as follows: the following described land shall Said land is more particularl Lots 12 to 14, 17 to 19, 39 to 41, 44 to 46, East 28.59 feet of Lots of 15, 16, 42, and 43, "Lake Village", according to the Plat thereof, as recorded in Plat Book 21, page 18, of the Public Records of Palm Beach County, and together with the following parcel: That part of the West 253.59 feet of the South 158.32 feet of the North 473.06 feet of Goverr~ent Lot ~2 lying East of U.S. 1 right-of-way. Containing 3.10 acres, more or less, and subject to easements and right-of-way records. Section 2: That any maps adopted in accordance with the Land Use Element of said Comprehensive Plan shall be amended accordingly. Section 3: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance.
