AN ORDINANCE OF THE CITY COMMISSION OF
THE CI~f OF BOYNTON BEACH, FLORIDA,
AMENDING THE TEXT OF THE SUPPORT
DOCUMENTS OF THE FUTURE LAND USE ELEMENT
OF THE COMPREHENSIVE PLAN IN CONNECTION
WITH APPLICATION NO. 25, PLA/~NING AP~EA
3.F; SAID TEXT AMENDMENT WILL ALLOW A
LOCAL RETAIL COMMERCIAL LAND USE
DESIGNATION; PROVIDING A CONFLICTS
CLAUSE; PROVIDING A SEVEPJ~BILITY CLAUSE;
PROVIDING AUTHORITY FOR CODIFICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach
Florida has adopted a Comprehensive Plan and as part of said Plat

a Future Land Use Element by Ordinance 89-38 in accordance wit~
the Local Government Comprehensive Planning Act; and l
WHEREAS, Christopher Cutro, agent for the City of Boynto
Beach, Florida has applied to amend a portion of the Support
Documents of the Future Land Use Element entitled Land UsE
Problems and Opportunities, Planning Area No. 3, Area 3.f.; and
the procedure for amendment of the Comprehensive

WHEREAS, after public hearing and study, the City Commissior
deems it in the best interest of the inhabitants of said City tE
amend the text of the aforesaid Support Documents of the Future
Land Use Element of the Comprehensive Plan as adopted by the Cit~

NOW, THEREFORE, BE IT ORDAI~ BY THE CITY CO~ISSION OF T~
CITY OF BOY1F~ON BEACH, FLORIDA, THAT:
Section 1: The portion of the Support Documents of the
Future Land Use Element entitled Land Use Problems an~
Opportunities, Planning Area 3, Area 3.f. is hereby amended b5
deleting the words and figures in the strike-tP~ough type as
properties in the vicinity of this
segment of Boynton Beach Boulevard, and
has also adopted a Urban Design Plan for
the entire length of Boynton Beach
Boulevard.
The land use and zoning recommendations
contained in these two plans conflict to
some extent; therefore, the Comnr~nity
Redevelopment Plan should be construed
to supersede the Urban Design Plan in
the case of conflicts. Development and
redevelopment along the entire Boynton
Beach Boulevard corridor should
otherwise be generally consistent with
the the Boynton Beach Boulevard Urban
Design Guidelines, when these design
guidelines are adopted by the City
Commission. The land use and zoning
changes which are recommended in the
proposed Redevelopment Plan are
summarized below, and have been
incorporated into the Future Land Use
Plan:

which front on Boynton Beach Boulevard.
In accordance with the proposed
Community Redevelopment P~an, Office
Commercial land use should be construed
to extend to a full block depth, on both
sides of Boynton Beach Boulevard, if the
parcels in these blocks are combined and
developed in accordance with the
redevelopment plan.
Local Retail Commercial Site and
Southwest Corner of Boynton Beach
Boulevard and Seacrest Boulevard:
Expansion of the commercial land use and
zoning at the southwest corner of
Boynton Beach Boulevard and Seacrest
Boulevard should be permitted, in order
to allow for a retail or office project.
The land use for the residential lots
which lie to the north of N.W. 1st
Avenue and east of N.W. 1st Street
should be construed to be in the Local
Retail Commercial land use categor!~, if
these lots are combined with the lots
that front on Boynton Beach Boulevard
and Seacrest Boulevard to form a unified
retail or office project, in accordance
with the redevelopment plan.
Holiday Inn Site:
and C-3). In order to bring the entire
site into conformance with the Future
Land Use Map and the zoning regulations,
the entire site should be placed in the
Local Retail Commercial land use
category and C-3 Community Commercial
zoning district.
Section 2: That all ordinances or parts of ordinances i~
conflict herewith be and the same are hereby repealed.
Section 3: Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or work bE
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the remainder of this Ordinance.
4: Authority is hereby granted to codify said
