O92-27ORDINANCE NO. 092- 27 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING APPLICATION NO. 25, PLANNING AREA 3.F (LOTS ON THE NORTH AND SOUTH SIDES OF BOYNTON BEACH BOULEVARD, BETWEEN 1-95 AND SEACREST BOULEVARD) AMENDING ORDINANCE 89-38 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY ADOPTING THE PROPER LAND USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREINAFTER; SAID LAND DESIGNATION IS BEING CHANGED FROM OFFICE COMMERCIAL TO LOCAL RETAIL COMMERCIAL; PROVIDING A SAVINGS CLAUSE; PROVIDING REPEALING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. W~EREAS, the City Commission of the Florida has adopted a Comprehensive Land City of Boynton Beach Use Plan and as part of said Plan a Land Use Element by Ordinance No. 89-38 in accordanc~ with the Local Government Comprehensive Planning Act; and WHERF~, the City Commission of the City of Boynton Beach Florida adopted as part of said Plan a portion of the Suppor~ Documents of the Future Land Use Element entitled Section VIII Land Use Problems and Opportunities; and WHEREAS, the City Commission of the City of Boynton Beach ' n n Ma Florida elected not to amend the City s Official Zo i pursuant to recommendations within said Section VIII. (Plannin~ Area 3, Area 3.f); and WHEREAS, Christopher Cutro, agent for Beach Florida, has heretofore requested the the City of Boynto~ above mentioned Land Use Element Amendment; and WHEREAS, the procedure for amendment of a Land Use Elemen~ of a Comprehensive Plan as set forth in Chapter 163, Florid~ Statutes, has been followed; and WHEREAS, after public hearing and study, the City Con~issio~ deems it in the best interest of the inhabitants of said City t6 That the Land Use of the following described land shall be Local Retail Commercial. Said land is more particularly described as follows: Lots 1, 2 (less the South 10 feet for S.R. 804 R/W), Plus the South 1/2 of Lot 3, plus Lots 127, 128, 129, 130, 131 (less the South 10 feet for S.R. 804 R/W), plus the South 13 feet of Lot 132, "Ridgewood Hills," according to the plat thereof, as recorded in Plat Book 23, Page 250 of the Public Records of Palm Beach County, Florida, also Lots 83, 84, 85, 86, 87, 89, 90 (less the South 10 feet for S.R. 804 R/W), "Ridgewood", according to the plat thereof, as recorded in Plat Book 13, Page 7 of the Public Records of Palm Beach County, Florida, also Lots 100 to 115, inclusive, plus Lot 179 (less the South 10 feet for S.R. 804 R/W), plus the East 1/2 of Lot 127, plus Lots 128 to 134, inclusive, plus Lot 180, "Boynton Hills", according to the plat thereof, as recorded in Plat Book 4, Page 51 of the Public Records of Palm Beach County, Florida, also Lots 1 to 16, inclusive, of Block 3 (less the North 10 feet for S.R. 804 R/W), plus Lots 1 to 18 inclusive, of Block 2 (less the North 10 feet for S.R. 804 R/W), plus Lot 1 of Block 1, (less the North 10 feet for S.R. 804 R/W), plus Lots 4, 5, "Boynton Heights Addn. Rev. Plat," according to the plat thereof, as recorded in Plat Book 10, Page 64 of the Public Records of Palm Beach County, Florida, also Lots 1 to 6, inclusive, (less the North 10 feet for S.R. 804 R/W), "Boynton Heights Addn. No. 1," according to the plat thereof, as recorded in Plat Book 4, Page 7 of the Public Records of Palm Beach County, Florida, also The East 134 feet of the North 1/2 of Lot 5, (less the North 40 feet for S.R. 804 R/W), "Boynton Beach Subdivision of Section 28," according to the plat thereof, as recorded in Plat Book 1, Page 4 of the Public Records of Palm Beach County, Florida. Containing 8.94 acres, more or less, and Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance.
