O92-26ORDINANCE NO. 092- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING THE TEXT OF THE SUPPORT DOCUMENTS OF THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN IN CONNECTION WITH APPLICATION NO. 10, PLANNING AREA 4..A; SAID TEXT AMENDMENT WILL ALLOW A LOW DENSITY LAND USE DESIGNATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Co~mission of the City of Boynton Beach Florida has adopted a Comprehensive Plan and as part of said Pla~ a Future Land Use Element by Ordinance 89-38 in accordance witH the Local Government Comprehensive Planning Act; and W~n~KEAS, Christopher Cutro, agent for the City of Bo!rnto! Beach, Florida has applied to amend a portion of the Support Documents of the Future Land Use Element entitled Land Us~ Problems and Opportunities, Planning Area No. 4, Area 4oa.; and WHEREAS, the procedure for amendment of the Comprehensiv~ Plan as set forth in Chapter 163, Florida Statutes, has bee followed; and WHEREAS, after public hearing and study, the City Commissiol deems it in the best interest of the inhabitants of said City t¢ amend the text of the aforesaid Support Documents of the Futur~ Land Use Element of the Comprehensive Plan as adopted by the Cit~ herein. NOW, THEREFOHE, BE IT ORDAINED BY THE CITY CO~SSION OF TH~ CITY OF BOYNTON BEACH, FLORIDA, T~AT: Section 1: The portion of the Support Documents of thc Future Land Use Element entitled Land Use Problems and Opportunities, Planning Area 4, Area 4.a. is hereby amended by deleting the words and figures in the strike-through type a~ Boulevard was placed in a single-family zoning district in 1980, in order to maintain the single-family character of this neighborhood. It is desirable for this zoning to continue. It is also desirable for the R-2 and R-3 zoning along Seacrest Boulevard to continue, since the existing dwellings along this frontage are well-maintained, commercial uses would create an intrusion, and the city is attempting to concentrate commercial development in the CBD and along Bolrnton Beach Boulevard. In order to promote compatibility between the industrial district lying between S.E. 1st Street and the FEC tracks, buildin~ h~h~ ~,,~ ~ Section 2: That all ordinances or parts of ordinances ir conflict herewith be and the same are hereby repealed. Section 3: Should any section or provision of thi: ordinance or portion hereof, any paragraph, sentence, or work b~ declared by a court of competent jurisdiction to be invalid, suc! decision shall not affect the remainder of this Ordinance.
