AN ORDINANCE~ OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING APPLICATION NO. 10, PLANNING
AREA 4.A (LOTS ON SOUTH SIDE OF S.E.
14TH AVENUE, WEST OF THE FEC TRACKS)
AMENDING ORDINANCE 89-38 OF SAID CITY BY
AMENDING THE LAND USE ELF~ENT OF THE
COMPREHF/~S IVE PLAN OF THE CITY BY
ADOPTING THE PROPER LAND USE OF CERTAIN
PROPERTY, MORE PARTICULARLY DESCRIBED
HEREINAFTER; SAID LAND DESIGNATION IS
BEING CHANGED FROM MEDIUM DENSITY
RESIDENTIAL TO LOW DENSITY RESIDENTIAL;
PROVIDING A SAVINGS CLAUSE; PROVIDING
REPEALING PROVISIONS; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Bolrnton Beach
Florida has adopted a Comprehensive Land Use Plan and as part of
said Plan a Land Use Element by Ordinance No. 89-38 in accordanc~
with the Local Government Comprehensive Planning Act; and
WHEREAS, the City Co~L,~ission of the City of Boynton Beach
Florida adopted as part of said Plan a portion of the Suppo~
Documents of the Future Land Use Element entitled Section VIII.
Land Use Problems and Opportunities; and
WHEREAS, the City Commission of the City of Boynton Beack
Florida elected not to amend the City's Official Zoning M~
pursuant to reconunendations within said Section VIII. (Plannit
Area 4, Area 4.a); and
WHEREAS, Christopher Cutro, agent for the City of Boyntc
Beach Florida, has heretofore requested the above mentioned Lan~
Use Element Amendment; and
WHEREAS, the procedure for amendment of a Land Use Elemen~
of a Comprehensive Plan as set forth in Chapter 163, Florid~
Statutes, has been followed; and
WHEREAS, after public hearing and study, the City Commissio~
deems it in the best interest of the inhabitants of said City t¢

11, "Central Park Annex," according to
the Plat thereof, as recorded in Plat
Book 12, Page 51 of the Public Records
of Palm Beach County, Florida.
Containing 1.17 acres, more or less, and
subject to easements and rights-of-way
record.
Section 2: That any maps adopted in accordance with
the Land Use Element of said Comprehensive Plan shall be
amended accordingly.
Section 3: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 5: This Ordinance shall become effective
immediately upon its final passage.
