AN ORDINANCE OF THE CITY ~COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING THE TEXT OF THE SUPPORT
DOCUMENTS OF THE FUTURE LAND USE ELEMENT
OF THE COMPREHENSIVE PLAN IN COnNECTiON
WITH APPLICATION NO. 3, PLANNING AREA
4.h; SAID TEXT AMENDMENT WILL ALLOW A
MEDIUM DENSITY LAND USE DESIGNATION;
PROVIDING A CONFLICTS CLAUSE; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING
AUTHORITY FOR CODIFICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach
Florida has adopted a Comprehensive Plan and as part of said Plal
a Future Land Use Element by Ordinance 89-38 in accordance witl
the Local Government Comprehensive Planning Act; and
W/~EREAS, Christopher Cutro, agent for the City of Boyntor
Beach, Florida has applied to amend a portion of the Suppor~
Documents of the Future Land Use Element entitled Land Us.
Problems and Opportunities, Planr~ng Area No. 4, Area 4.h.; and
WHEREAS, the procedure for amendment of the Comprehensi~
Plan as set forth in Chapter 163, Florida Statutes, has bee~
followed; and
WHEREAS, after public hearing and stud~, the City Commissio~
deems it in the best interest of the inhabitants of said City t(
amend the text of the aforesaid Support Documents of the Futur~
Land Use Element of the Comprehensive Plan as adopted by the Cit
herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO~ISSION OF T~
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The portion of the Support Documents of thc
Future Land Use Element entitled Land Use Problems and
Opportunities, Planning Area 4, Area 4.h. is hereby amended b}
adding the underlined text and by deleting the words and figures

Section 2: That all ordinances or parts of ordinances
conflict herewith be and the same are hereby repealed.
Section 3: Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or work b~

declared by a court of competent jurisdiction to be invalid, suc~
decision shall not affect the remainder of this Ordinance.
Section 4: Authority is hereby granted to codify sai(
ordinanoe.
Section 5: This Ordinance shall
