AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING THE TEXT OF THE SUPPORT
DOCUMENTS OF THE FUTURE LAND USE ELEMENT
OF THE COMPREHENSIVE PLAN IN CONNECTION
WITH APPLICATION NO. 26, PLANNING ARF~A
3.F; SAID TEXT AMENDMENT WILL ALLOW A
OFFICE COMMERCIAL LAND USE DESIGNATION;
PROVIDING A CONFLICTS CLAUSE; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING
AUTHORITY FOR CODIFICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach
Florida has adopted a Comprehensive Plan and as part of said Plal
a Future Land Use Element by Ordinance 89-38 in accordance with
the Local Government Comprehensive Planning Act; and
WH~KEAS, Christopher Cutro, agent for the City of Boynton
Beach, Florida has applied to amend a portion of the Support
Documents of the Future Land Use Element entitled Land Us~
Problems and Opportunities, Planning Area No. 3, Area 3.f.; and
WHEREAS, the procedure for amendment of the Comprehensiw
Plan as set forth in Chapter 163, Florida Statutes, has bee~
followed; and
W74RREAS, after public hearing and study, the City Commission
deems it in the best interest of the inhabitants of said City tc
amend the text of the aforesaid Support Documents of the Futur,
Land Use Element of the Comprehensive Plan as adopted by the Cit~
herein.
NOW, T~EREFORE, BE IT OIIDAI-NED BY
CITY OFBOYNTON BEACH, FLORIDA, THAT:
Section 1: The portion of the Support Documents of thd
Future Land Use Element entitled Land Use Problems an~
Opportunities, Planning Area 3, Area 3.f. is hereby amended
deleting the words and figures in the strike-through type a1

segment of Boynton Beach Boulevard, and
has also adopted a Urban Design Plan for
the entire length of Boynton Beach
Boulevard.
The land use and zoning recommendations
contained in these two plans conflict to
some extent; therefore, the Community
Redevelopment Plan should be construed
to supersede the Urban Design Plan in
the case of conflicts. Development and
redevelopment along the entire Boynton
Beach Boulevard corridor should
otherwise be generally consistent with
the the Boynton Beach Boulevard
Design Guidelines, when these
guidelines are adopted by the
Commission. The land use and
changes which are recommended in
proposed Redevelopment Plan
summarized below, and have
incorporated into
Plan:

The Local Retail Commercial land use
which lies on both sides of Boynton

In accordance with the proposed
Community Redevelopment Plan, Office
Commercial land use should be construed
to extend to a full block depth, on both
sides of Boynton Beach Boulevard, if the
parcels in these blocks are combined and
developed in accordance with the
redevelopment plan.
Local Retail Commercial Site and
Southwest Corner of Boynton Beach
Boulevard and Seacrest Boulevard:
Expansion of the commercial land use and
zoning at the southwest corner of
Boynton Beach Boulevard and Seaorest
Boulevard should be permitted, in order
to allow for a retail or office project.
The land use for the residential lots
which lie to the north of N.W. 1st
Avenue and east of N.W. 1st Street
should be construed to be in the Local
Retail Commercial land use category, if
these lots are combined with the lots
that front on Bo!rnton Beach Boulevard
and Seacrest Boulevard to form a unified
retail or office project, in accordance
with the redevelopment plan.

Section 2: That all ordinances or parts of ordinances ir
conflict herewith be and the same are hereby repealed.
Section 3: Should any section or provision of thi:
ordinance or portion hereof, any paragraph, sentence, or work b~
declared by a court of competent jurisdiction to be invalid, suck
decision shall not affect the remainder of this Ordinance.
