O92-18ORDINANCE NO. 092- AN ORDINANCE ~ OF THE CITY COMMISSION OF-~ THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING APPLICATION NO. 26, PLANNING AREA 3. F ( S. E. CORNER OF I - 95 AND BOYNTON BEACH BOULEVARD, A PORTION OF THE SITE OCCUPIED BY THE HOLIDAY INN) AMENDING ORDINANCE 89-38 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY ADOPTING THE PROPER LAND USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREINAFTER; SAID LAND DESIGNATION IS BEING CHANGED FROM LOCAL RETAIL COMMERCIAL TO OFFICE COMMERCIAL; PROVIDING A SAVINGS CLAUSE; PROVIDING REPEALING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted a Comprehensive Land Use Plan and as part o~ said Plan a Land Use Element by Ordinance No. 89-38 in accordance with the Local Government Comprehensive Planning Act; and W~n~EAS, the City Commission of the City of Bo!rnton Beach, Florida adopted as part of said Plan a portion of the Support Documents of the Future Land Use Element entitled Section VIII~ Land Use Problems and Opportur~ties; and W/~/~cFRkS, the City Commission of the City of Boynton Beach Florida elected not to amend the City's Official Zoning Ma~ pursuant to recommendations within said Section VIII. (Planninc Area 3, Area 3.f); and WHEREAS, Christopher Cutro, agent for the City of Boynto Beach Florida, has heretofore requested the above mentioned Land Use Element Amendment; and WHEREAS, the procedure for amendment of a Land Use Element of a Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and W~EA$, after public hearing and stud~, the City Commission ~m~ ~ ~ ~h~ b~st inter, st of th~ inhabitants of said City tc That the Land Use of the following described land shall bE Office Cormuercial. Said land is more particularly described~ aE follows: Lots 1, 2 (less the North 10 feet of R/W), and Lots 9, 10 of Block 71, "Beverly Hills, Addn. No. 3," according to the plat thereof, as recorded in Plat Book 13, Page 64 of the Public Records of Palm Beach County, Florida, and West 160 feet of East 294 feet of North 165 feet of North 1/2 of Lot 5, (Less the North 40 feet for R/W), "Boynton Beach Subdivision of Section 28, " according to the plat thereof, as recorded in Plat Book 1, Page 4 of the Public Records of Palm Beach County, Florida. Containing 1.06 acres, more or less, and subject to easements and rights-of-way record. Section 2: That any maps adopted in accordance with the Land Use Element of said Comprehensive Plan shall be amended accordingly. Section 3: Ail ordinances or parts of ordinances in conflict herewith are hereb~ repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance.
